أَخْبَرَنَا مُحَمَّدُ بْنُ عَلانَ بِأَذَنَةَ ، حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى الزِّمَّانِيُّ ، حَدَّثَنَا عَبْدُ الْوَهَّابِ الثَّقَفِيُّ ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ وَهْبِ بْنِ كَيْسَانَ ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " مَنْ أَحْيَى أَرْضًا مَيْتَةً فَهِيَ لَهُ ، وَمَا أَكَلَتِ الْعَوَافِي مِنْهَا فَهُوَ لَهُ صَدَقَةٌ " ، قَالَ أَبُو حَاتِمٍ : لَمَّا قَالَ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : فِي هَذَا الْخَبَرِ وَمَا أَكَلَتِ الْعَوَافِي مِنْهَا فَهُوَ لَهُ صَدَقَةٌ ، كَانَ فِيهِ أَبْيَنُ الْبَيَانِ بِأَنَّ الْخِطَابَ وَرَدَ فِي هَذَا الْخَبَرِ لِلْمُسْلِمِينَ دُونَ غَيْرِهِمْ ، وَأَنَّ الذِّمِّيَّ لَمْ يَقَعْ خِطَابُ الْخَبَرِ عَلَيْهِ ، وَأَنَّهُ إِذَا أَحْيَى الْمَوَاتَ لَمْ يَكُنْ لَهُ ذَلِكَ ، إِذِ الصَّدَقَةُ لا تَكُونُ إِلا لِلْمُسْلِمِينَ . وَقَدْ سَمِعَ هِشَامُ بْنُ عُرْوَةَ هَذَا الْخَبَرَ مِنْ وَهْبِ بْنِ كَيْسَانَ ، وَعَبْدُ اللَّهِ بْنُ عَبْدِ الرَّحْمَنِ بْنِ رَافِعِ بْنِ خَدِيجٍ ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ، وَهُمَا طَرِيقَانِ مَحْفُوظَانِ وَطُلابُ الرِّزْقِ يُسَمَّوْنَ الْعَافِيَةَ . قَالَهُ أَبُو حَاتِمٍ رَحِمَهُ اللَّهُ .
Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them) narrates this statement of the Noble Prophet (peace and blessings of Allah be upon him): "Whoever revives barren land, it becomes his property. Whatever animal, etc., eats from it, that thing will be charity for him."
(Imam Ibn Hibban, may Allah have mercy on him, says:) When the Noble Prophet (peace and blessings of Allah be upon him) said in this narration, "Whatever animal, etc., eats from it, that will be charity for him," there is a clear statement in this that the ruling present in this narration is for Muslims, not for others, and the ruling of this narration will not apply to dhimmis, that if they revive any barren land, it will not become their property, because charity is only from Muslims. Hisham bin Urwah heard this narration from Wahb bin Kaysan, and from Abdullah bin Abdur Rahman, he heard it from Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them); both of its chains are preserved. The word "afiyah" is used for seekers of sustenance (which is used in this hadith); this has been stated by Imam Abu Hatim.
