Hadith 5196

أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ سَلْمٍ ، قَالَ : حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ إِبْرَاهِيمَ ، قَالَ : حَدَّثَنَا الْوَلِيدُ ، قَالَ : حَدَّثَنَا الأَوْزَاعِيُّ ، عَنْ رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ ، عَنْ حَنْظَلَةَ بْنِ قَيْسٍ الزُّرَقِيُّ ، عَنْ رَافِعِ بْنِ خَدِيجٍ ، قَالَ : " كُنَّا نُكْرِي الأَرْضَ ، فَيَسْتَثْنِي صَاحِبَ الأَرْضِ مَا عَلَى الْمَاذِيَانَاتِ وَأَقْبَالِ الْجَدَاوِلِ ، فَيَهْلِكُ هَذَا ، وَيَسْلَمُ هَذَا ، فَنَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِكَ ، فَقَالَ رَافِعٌ : أَمَّا بِشَيْءٍ مَضْمُونٍ مَعْلُومٍ ، فَلا بَأْسَ بِهِ " .
Sayyiduna Rafi’ bin Khadij (may Allah be pleased with him) narrates: Previously, we used to lease out land, and the owner of the land would exclude a specific part of the field and the area around the water source. Sometimes, the produce of one part would be ruined while the other part would remain fine, so the Prophet Muhammad (peace and blessings be upon him) forbade this. Sayyiduna Rafi’ (may Allah be pleased with him) says: However, if the land is leased in exchange for a specified thing, then there is no harm in it.
