Hadith 5189

أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ سَلْمٍ ، قَالَ : حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ إِبْرَاهِيمَ ، قَالَ : حَدَّثَنَا الْوَلِيدُ ، قَالَ : حَدَّثَنَا الأَوْزَاعِيُّ ، قَالَ : حَدَّثَنِي عَطَاءٌ ، قَالَ : سَمِعْتُ جَابِرَ بْنَ عَبْدِ اللَّهِ ، يَقُولُ : كَانَتْ لِرِجَالٍ مِنَّا فُضُولُ أَرَضِينَ يُؤَاجِرُونَهَا عَلَى الثُّلُثِ وَالرُّبُعِ وَالنِّصْفِ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ كَانَتْ لَهُ فُضُولُ أَرَضِينَ فَلْيَزْرَعْهَا ، أَوْ لِيُزْرِعْهَا أَخَاهُ ، فَإِنْ أَبَى فَلْيُمْسِكْ أَرْضَهُ " ، قَالَ أَبُو حَاتِمٍ رَضِيَ اللَّهُ عَنْهُ : قَوْلُهُ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَوْ لِيُزْرِعْهَا أَخَاهُ ، يُرِيدُ بِهِ فَلْيَمْنَحْهَا أَخَاهُ ، وَلَوْ كَانَ ذَلِكَ الزِّرَاعَةَ نَفْسَهَا لَمْ يَكُنْ لِقَوْلِهِ أَوْ لِيَزْرَعْهَا مَعْنَى ، لأَنَّهُمْ كَانُوا يُزَارِعُونَ عَلَى الثُّلُثِ وَالرُّبُعِ وَالنِّصْفِ عَلَى مَا فِي الْخَبَرِ .
Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) narrates: Previously, some of us had extra land. They would lease out these lands for one third, one fourth, or half of the produce. The Prophet Muhammad (peace be upon him) said: Whoever has extra land should cultivate it himself or give it to his brother to cultivate. If he does not accept, then he should keep the land with himself. (But he should not lease it out.) (Imam Ibn Hibban, may Allah have mercy on him, says:) The statement of the Prophet (peace be upon him): "Or he should let his brother cultivate it," by this he meant: he should give it to his brother for temporary use without compensation. If sharecropping was intended by this, then the statement of the Prophet (peace be upon him): "He should cultivate it," would have no meaning, because those people were already practicing sharecropping for one third, one fourth, or half of the produce, as mentioned in the narration.
