Hadith 5060

أَخْبَرَنَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ الشَّرْقِيِّ ، قَالَ : حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى الذُّهْلِيُّ ، وَحَدَّثَنَا ابْنُ قُتَيْبَةَ ، حَدَّثَنَا ابْنُ أَبِي السَّرِيِّ ، قَالا : حَدَّثَنَا عَبْدُ الرَّزَّاقِ ، قَالَ : أَخْبَرَنَا مَعْمَرٌ ، عَنِ الثَّوْرِيِّ ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ ، عَنْ أَبِي سَلَمَةَ ، عَنْ أَبِي هُرَيْرَةَ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِذَا حَكَمَ الْحَاكِمُ فَاجْتَهَدَ فَأَصَابَ فَلَهُ أَجْرَانِ ، وَإِذَا حَكَمَ فَاجْتَهَدَ فَأَخْطَأَ فَلَهُ أَجْرٌ " ، قَالَ أَبُو حَاتِمٍ رَضِيَ اللَّهُ عَنْهُ : مَا رَوَى مَعْمَرٌ عَنِ الثَّوْرِيِّ مُسْنِدًا إِلا هَذَا الْحَدِيثَ .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that the Prophet Muhammad (peace and blessings be upon him) said: "When a judge makes a decision by exerting effort (ijtihad) and is correct, he receives two rewards, and when he makes a decision by exerting effort and makes a mistake, he receives one reward."
(Imam Ibn Hibban, may Allah have mercy on him, says:) Mu'ammar has narrated this same narration from Thawri as a musnad narration.
