Hadith 4954

أَخْبَرَنَا عُمَرُ بْنُ سَعِيدِ بْنِ سِنَانٍ ، قَالَ : أَخْبَرَنَا أَحْمَدُ بْنُ أَبِي بَكْرٍ ، عَنْ مَالِكٍ ، عَنْ أَبِي الزِّنَادِ ، عَنِ الأَعْرَجِ ، عَنْ أَبِي هُرَيْرَةَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " لا يُمْنَعُ فَضْلُ الْمَاءِ لِيُمْنَعَ بِهِ الْكَلأُ " ، قَالَ أَبُو حَاتِمٍ : أَضْمَرَ فِيهِ الْمَاءَ الَّذِي لا يَقَعُ فِيهِ الْحَوْزُ وَلا يَتَمَلَّكُهُ أَحَدٌ مَا دَامَ مَشَاعًا مِثْلَ الْمِيَاهِ الْجَارِيَةِ الْمُشْتَرِكَةِ بَيْنَ النَّاسِ ، وَيَحْتَمِلُ أَنْ يَكُونَ مَعْنَاهُ الْمَاءُ الَّذِي يَكُونُ لِلْمَرْءِ فِي الْبَادِيَةِ مِنْ بِئْرٍ أَوْ عَيْنٍ فَيَنْتَفِعُ بِهِ ، وَيَمْنَعُ النَّاسَ مَا فَضَلَ عَنْهُ ، فَنُهِيَ عَنْ مَنْعِ الْمُسْلِمِينَ مَا فَضَلَ مِنْ مَائِهِ بَعْدَ قَضَاءِ حَاجَتِهِ عَنْهُ ، لأَنَّ فِي مَنْعِهِ ذَلِكَ مَنْعَ النَّاسِ عَنِ الْكَلإِ .
Sayyiduna Abu Hurairah, may Allah be pleased with him, narrates this statement of the Prophet Muhammad, peace and blessings be upon him: "Do not prevent others from excess water, otherwise as a result, grass will stop growing." (Imam Ibn Hibban, may Allah have mercy on him, says:) In this, it is implied that what is meant is the water in which there is no reservoir. (That is, there is no wall built around it) No single person owns it and it is used collectively among people, like flowing water which is shared, and there is also the possibility that what is meant is the water of a well or spring in the wilderness, and benefit is derived from it, so a person prevents people from using the excess water. And it is prohibited that after fulfilling one's own need, Muslims are prevented from using the excess water, because preventing them from this would also necessarily prevent people from obtaining grass.
