أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ الأَزْدِيُّ ، حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ ، أَخْبَرَنَا جَعْفَرُ بْنُ عَوْنٍ ، حَدَّثَنَا ابْنُ أَبِي ذِئْبٍ ، عَنْ مَخْلَدِ بْنِ خُفَافٍ ، قَالَ : " كَانَ بَيْنِي وَبَيْنَ شُرَكَاءَ لِي عَبْدٌ فَاقْتَوَيْنَاهُ بَيْنَنَا ، وَكَانَ بَعْضُ الشُّرَكَاءِ غَائِبًا ، فَقَدِمَ وَأَبَى أَنْ يُجِيزَهُ ، فَخَاصَمْنَا إِلَى هِشَامٍ ، فَقَضَى بِرَدِّ الْغُلامِ وَالْخَرَاجِ ، وَكَانَ الْخَرَاجُ بَلَغَ أَلْفًا ، فَأَتَيْتُ عُرْوَةَ بْنَ الزُّبَيْرِ ، فَأَخْبَرْتُهُ ، فَقَالَ : أَخْبَرَتْنِي عَائِشَةُ ، عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّهُ قَضَى أَنَّ الْخَرَاجَ بِالضَّمَانِ " ، قَالَ : فَأَتَيْتُ هِشَامًا فَأَخْبَرْتُهُ ، فَرَدَّهُ وَلَمْ يَرُدَّ الْخَرَاجَ .
Mukhlad bin Khafaf says: There was a slave in joint ownership between me and some of my relatives (we sold him). One relative was not present there; when he came, he refused to uphold this deal. We took our case to Hisham, so he decided that the slave would be returned and the kharaj (earnings) would also be returned. The amount of kharaj reached up to one thousand (dinars or dirhams). I went to Urwah bin Zubair. I told him about this, so he informed me: Sayyidah Aisha (may Allah be pleased with her) told me this: The Prophet Muhammad (peace and blessings be upon him) said: "The kharaj is according to the guarantee (liability)." The narrator says: I went to Hisham and told him about this, so he returned the slave but did not return the kharaj.
