أَخْبَرَنَا الْفَضْلُ بْنُ الْحُبَابِ الْجُمَحِيُّ ، قَالَ : حَدَّثَنَا مُسَدَّدُ بْنُ مُسَرْهَدٍ ، عَنْ بِشْرِ بْنِ الْمُفَضَّلِ ، قَالَ : حَدَّثَنَا ابْنُ عَوْنٍ ، عَنْ نَافِعٍ 2 ، عَنِ ابْنِ عُمَرَ ، قَالَ : أَصَابَ عُمَرُ أَرْضًا بِخَيْبَرَ ، فَأَتَى فِيهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَاسْتَأْمَرَهُ ، فَقَالَ : إِنِّي أَصَبْتُ أَرْضًا بِخَيْبَرَ لَمْ أُصِبْ قَطُّ مَالا أَنْفَسَ عِنْدِي مِنْهُ ، فَمَا تَأْمُرُ فِيهَا ؟ فَقَالَ : " إِنْ شِئْتَ حَبَسْتَ أَصْلَهَا ، وَتَصَدَّقْتَ بِهَا عَلَى أَنَّهُ لا يُبَاعُ وَلا يُوهَبُ وَلا يُورَثُ ، فَتَصَدَّقْ بِهَا فِي الْفُقَرَاءِ ، وَفِي الْغُرَبَاءِ ، وَفِي الرِّقَابِ ، وَفِي سَبِيلِ اللَّهِ ، وَابْنِ السَّبِيلِ ، وَفِي الضَّيْفِ ، لا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ مِنْهَا بِالْمَعْرُوفِ ، أَوْ يُطْعِمَ صَدِيقًا غَيْرَ مُتَمَوِّلٍ فِيهِ " ، قَالَ : وَقَالَ مُحَمَّدٌ : غَيْرَ مُتَأَثِّلٍ مَالا .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates: Sayyiduna Umar (may Allah be pleased with him) acquired a piece of land in Khaybar. He went to the service of the Prophet Muhammad (peace and blessings be upon him) regarding it and consulted him. He said: I have acquired a piece of land in Khaybar, and I have never acquired land that is more valuable to me than this. What do you instruct me regarding it? The Prophet Muhammad (peace and blessings be upon him) said: If you wish, keep the original land with you and give its (produce and income) as charity. On the condition that the land itself will not be given as charity, nor will it be given as a gift, nor will it be inherited. Spend (its produce) among the poor, travelers, slaves, in the way of Allah (for those going out for jihad), travelers, and guests. There will be no sin upon the person who manages it if he eats from it in a reasonable manner or feeds a friend from it, as long as he is not accumulating wealth. Here, the narrator named Muhammad has narrated one word differently.
