أَخْبَرَنَا
الْقَطَّانُ بِالرَّقَّةِ ، حَدَّثَنَا
أَيُّوبُ بْنُ مُحَمَّدٍ الْوَزَّانُ ، حَدَّثَنَا
إِِسْمَاعِيلُ بْنُ عُلَيَّةَ ، عَنْ
يُونُسَ بْنِ عُبَيْدٍ ، عَنِ
الْحَسَنِ ، قَالَ : قَالَ رَجُلٌ
لِعِمْرَانَ بْنَ حُصَيْنٍ : إِِنَّ لِي عَبْدًا أَبَقَ ، وَإِِنِّي نَذَرْتُ لِلَّهِ إِِنْ أَصَبْتُهُ لأَقْطَعَنَّ يَدَهُ ، فَقَالَ : لا تَقْطَعْ يَدَهُ ، فَإِِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ يَقُومُ فِينَا " فَيَأْمُرُنَا بِالصَّدَقَةِ وَيَنْهَانَا عَنِ الْمُثْلَةِ " . قَالَ أَبُو حَاتِمٍ رَضِيَ اللَّهُ عَنْهُ : الْمُثْلَةُ الْمَنْهِيُّ عَنْهَا لَيْسَ الْقَوَدُ الَّذِي أَمَرَ بِهِ ، لأَنَّ أَخْبَارَ الْعُرَنِيِّينَ الْمُرَادُ مِنْهَا كَانَ الْقَوَدَ لا الْمُثْلَةَ .
Hasan Basri narrates: A man said to Sayyiduna Imran bin Husain (may Allah be pleased with him): We have a slave, and I have made a vow in the name of Allah that if I find him, I will surely cut off his hand. So Sayyiduna Imran (may Allah be pleased with him) said: Do not cut off his hand, because the Noble Prophet (peace and blessings be upon him) once stood among us and commanded us to give charity, and he forbade us from mutilation. (Imam Ibn Hibban, may Allah have mercy on him, says:) What is meant by the forbidden mutilation is: it should not be as retribution, because in the narrations about the people of the tribe of ‘Uraina, it is mentioned that it was retribution, not mutilation.
