Hadith 4355

أَخْبَرَنَا أَبُو خَلِيفَةَ ، حَدَّثَنَا مُسَدَّدُ بْنُ مُسَرْهَدٍ ، عَنْ يَزِيدَ بْنِ زُرَيْعٍ ، حَدَّثَنَا حَبِيبٌ الْمُعَلِّمُ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، أَنَّ أَخَوَيْنِ مِنَ الأَنْصَارِ كَانَ بَيْنَهُمَا مِيرَاثٌ ، فَسَأَلَ أَحَدُهُمَا صَاحِبَهُ الْقِسْمَةَ ، فَقَالَ : لَئِنْ عُدْتَ تَسْأَلُنِي الْقِسْمَةَ لَمْ أُكَلِّمْكَ أَبَدًا ، وَكُلُّ مَالٍ لِي فِي رِتَاجِ الْكَعْبَةِ ، فَقَالَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ : إِِنَّ الْكَعْبَةَ لَغَنِيَّةٌ عَنْ مَالِكَ ، كَفِّرْ عَنْ يَمِينِكِ وَكَلِّمْ أَخَاكَ ، فَإِِنِّي سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " لا يَمِينَ عَلَيْكَ ، وَلا نَذَرَ فِي مَعْصِيَةٍ ، وَلا فِي قَطِيعَةِ رَحِمٍ ، وَلا فِيمَا لا تَمْلِكُ " .
Saeed bin Musayyib narrates: There were two brothers from among the Ansar who had an issue regarding inheritance between them. One of them demanded division from the other, so he said: If you ask me for division again, I will never speak to you again, and all this wealth will be dedicated to the treasury of the Ka'bah. So, Sayyiduna Umar bin Khattab (may Allah be pleased with him) said: Indeed, the Ka'bah is free of need from your wealth. You should offer expiation for your oath and speak with your brother, because I heard the Noble Prophet (peace and blessings be upon him) say: "No oath or vow is binding upon you in a sinful matter, in the severing of ties of kinship, or regarding something that is not in your possession."
