عُمَرُ بْنُ مُحَمَّدٍ الْهَمْدَانِيُّ ، قَالَ : حَدَّثَنَا
عَمْرُو بْنُ عُثْمَانَ ، قَالَ : حَدَّثَنَا
الْوَلِيدُ ، عَنِ
ابْنِ جُرَيْجٍ ، قَالَ : أَخْبَرَنِي
عَطَاءٌ ، عَنْ
عَبْدِ اللَّهِ بْنِ عَمْرِو بْنِ الْعَاصِ ، أَنَّهُ قَالَ : يَا رَسُولَ اللَّهِ ، إِِنَّا نَسْمَعُ مِنْكَ أَحَادِيثَ ، أَفَتَأْذَنُ لَنَا أَنْ نَكْتُبَهَا ؟ قَالَ : " نَعَمْ " . فَكَانَ أَوَّلُ مَا كَتَبَ كِتَابَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِِلَى أَهْلِ مَكَّةَ : " لا يَجُوزُ شَرْطَانِ فِي بَيْعٍ وَاحِدٍ ، وَلا بَيْعٌ وَسَلَفٌ جَمِيعًا ، وَلا بَيْعُ مَا لَمْ يُضْمَنْ ، وَمَنْ كَانَ مُكَاتَبًا عَلَى مِائَةِ دِرْهَمٍ فَقَضَاهَا إِِلا عَشْرَةَ دَرَاهِمَ ، فَهُوَ عَبْدٌ ، أَوْ عَلَى مِائَةِ أُوقِيَّةٍ ، فَقَضَاهَا إِِلا أُوقِيَّةً فَهُوَ عَبْدٌ " .
Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with him) narrates: He said, "O Messenger of Allah (peace and blessings be upon him)! We hear some ahadith from you, so will you permit us to write them down?" The Prophet (peace and blessings be upon him) said, "Yes." This was at the time when the Prophet (peace and blessings be upon him) first sent a letter to the people of Makkah (in which it was written): "It is not permissible to stipulate two conditions in one transaction, and it is not permissible to combine a sale and a loan in one transaction, and it is also not permissible to make a transaction in which there is no guarantee. And whoever becomes a mukatab (contracted slave) for one hundred dirhams and pays all except ten dirhams, he will be considered a slave. Or if someone made a contract of manumission for one hundred uqiyyah and pays all except one uqiyyah, then that person will be considered a slave."
