عُمَرُ بْنُ سَعِيدِ بْنِ سِنَانَ ، قَالَ : أَخْبَرَنَا
أَحْمَدُ بْنُ أَبِي بَكْرٍ ، عَنْ
مَالِكٍ ، عَنْ
يَحْيَى بْنِ سَعِيدٍ ، عَنْ
سُلَيْمَانَ بْنِ يَسَارٍ ، أَنَّ عَبْدَ اللَّهِ بْنَ عَبَّاسٍ وَأَبَا سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ اخْتَلَفَا فِي الْمَرْأَةِ تَنْفَسُ بَعْدَ َفَاةِ زَوْجِهَا بِلَيَالٍ ، فَقَالَ عَبْدُ اللَّهِ : آخِرَ الأَجَلَيْنِ وَقَالَ أَبُو سَلَمَةَ : إِِذَا نُفِسَتْ فَقَدْ حَلَّتْ . قَالَ : فَجَاءَ أَبُو هُرَيْرَةَ ، فَقَالَ أَنَا مَعَ ابْنِ أَخِي يَعْنِي أَبَا سَلَمَةَ . فَبَعَثُوا كُرَيْبًا مَوْلَى ابْنِ عَبَّاسٍ إِِلَى
أُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَسَأَلَهَا عَنْ ذَلِكَ ، فَجَاءَهُمْ ، فَأَخْبَرَهُمْ أَنَّهَا قَالَتْ : " وَلَدَتْ سُبَيْعَةُ الأَسْلَمِيَّةُ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ ، فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ لَهَا : " قَدْ حَلَلْتِ فَانْكِحِي " .
Sulaiman bin Yasar narrates: There was a disagreement between Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) and Abu Salamah bin Abdur Rahman regarding a woman who gives birth to a child a few days after her husband's death. Sayyiduna Abdullah (may Allah be pleased with him) said: The waiting period (iddah) which ends later (the woman will observe iddah according to that). Abu Salamah said: As soon as she becomes postpartum (i.e., gives birth to the child), she becomes lawful (i.e., her iddah is considered finished). The narrator states: In the meantime, Sayyiduna Abu Hurairah (may Allah be pleased with him) arrived and said: I am with my nephew, meaning with Abu Salamah. They sent Sayyiduna Abdullah bin Abbas's (may Allah be pleased with them both) slave Kuraib to the service of Sayyidah Umm Salamah (may Allah be pleased with her), who is the noble wife of the Prophet (peace and blessings be upon him). He asked her about this matter, and then returned to these gentlemen and informed them that Sayyidah Umm Salamah (may Allah be pleased with her) stated: A woman named Subai’ah Aslamiyyah gave birth to a child a few days after her husband's death. This woman mentioned this to the Prophet (peace and blessings be upon him), so the Prophet (peace and blessings be upon him) said to her: Your iddah has ended, you may marry (again).
