مُحَمَّدُ بْنُ إِسْمَاعِيلَ الأَحْمَسِيُّ ، قَالَ : حَدَّثَنَا
وَكِيعٌ ، عَنْ
عَبْدِ الْعَزِيزِ بْنِ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ ، قَالَ : حَدَّثَنَا
الرَّبِيعُ بْنُ سَبْرَةَ الْجُهَنِيُّ ، عَنْ
أَبِيهِ ، قَالَ : خَرَجْنَا مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَلَمَّا قَضَيْنَا عُمْرَتَنَا ، قَالَ لَنَا : " اسْتَمْتِعُوا مِنْ هَذِهِ النِّسَاءِ " ، قَالَ : وَالاسْتِمْتَاعُ عِنْدَنَا يَوْمَئِذٍ التَّزْوِيجُ ، فَعَرَضْنَا بِذَلِكَ النِّسَاءُ أَنْ نَضْرِبَ بَيْنَنَا وَبَيْنَهُنَّ أَجَلا ، قَالَ : فَذَكَرْنَا ذَلِكَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " افْعَلُوا ذَلِكَ " ، فَخَرَجْتُ أَنَا ، وَابْنُ عَمٍّ لِي مَعِي بُرْدَةٌ ، وَمَعَهُ بُرْدَةٌ ، وَبُرْدُهُ أَجْوَدُ مِنْ بُرْدِي ، وَأَنَا أَشَبُّ مِنْهُ ، فَأَتَيْنَا امْرَأَةً فَعَرَضْنَا ذَلِكَ عَلَيْهَا ، فَأَعْجَبَهَا شَبَابِي ، وَأَعْجَبَهَا بُرْدُ ابْنِ عَمِّي ، فَقَالَتْ : بُرْدٌ كَبُرْدٍ ، فَتَزَوَّجْتُهَا ، وَكَانَ الأَجَلُ بَيْنِي وَبَيْنَهَا عَشْرًا ، فَلَبِثْتُ عِنْدَهَا تِلْكَ اللَّيْلَةَ ، ثُمَّ أَصْبَحْتُ غَادِيًا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَرَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَيْنَ الْحَجَرِ وَالْبَابِ قَائِمٌ يَخْطُبُ النَّاسَ وَهُوَ يَقُولُ : " أَيُّهَا النَّاسُ إِنِّي قَدْ أَذِنْتُ لَكُمْ فِي الاسْتِمْتَاعِ فِي هَذِهِ النِّسَاءِ ، أَلا وَإِنَّ اللَّهَ قَدْ حَرَّمَ ذَلِكَ إِلَى يَوْمِ الْقِيَامَةِ ، فَمَنْ كَانَ عِنْدَهُ مِنْهُنَّ شَيْئًا فَلْيُخَلِّ سَبِيلَهُ ، وَلا تَأْخُذُوا مِمَّا آتَيْتُمُوهُنَّ شَيْئًا " .
Rabi’ bin Sabrah al-Juhani narrates from his father: We set out to visit the Prophet (peace and blessings be upon him). When we had performed ‘Umrah, the Prophet (peace and blessings be upon him) said: Contract temporary marriage (mut‘ah) with women. The narrator says: In those days, in our view, mut‘ah was equivalent to marriage. We offered it to women, proposing that we marry them for a specified period. The narrator says: We mentioned this to the Prophet (peace and blessings be upon him), and he said: Do so. My cousin and I went out; I had a cloak and he had a cloak, and his cloak was better than mine, but I was younger than him. We came to a woman and proposed marriage to her. She liked my youth and liked my cousin’s cloak. She said: A cloak is a cloak. So I married that woman. There was an agreement between me and her to stay together for ten days. I stayed with her that night. The next day, I went to the Prophet (peace and blessings be upon him), who was standing between the Black Stone and the Ka‘bah, addressing the people. He (peace and blessings be upon him) was saying: “O people! I had permitted you to contract temporary marriage with women. Beware! Indeed, Allah has forbidden it until the Day of Resurrection. So whoever has such an agreement should leave those women, and do not take back anything you have given them.”
