Hadith 4101

أَخْبَرَنَا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ أَبِي عَوْنٍ ، قَالَ : حَدَّثَنَا عَلِيُّ بْنُ حِجْرٍ السَّعْدِيُّ ، قَالَ : حَدَّثَنَا عَلِيُّ بْنُ مُسْهِرٍ ، عَنْ دَاوُدَ بْنِ أَبِي هِنْدٍ ، عَنِ الشَّعْبِيِّ ، عَنْ عَلْقَمَةَ ، أَنَّ قَوْمًا أَتَوْا عَبْدَ اللَّهِ بْنَ مَسْعُودٍ ، فَقَالُوا : جِئْنَاكَ لِنَسْأَلَكَ عَنْ رَجُلٍ تَزَوَّجَ مِنَّا ، وَلَمْ يَفْرِضْ صَدَاقًا ، وَلَمْ يَجْمَعْهُمَا اللَّهُ حَتَّى مَاتَ ؟ ، فَقَالَ عَبْدُ اللَّهِ : مَا سُئِلْتُ عَنْ شَيْءٍ مُنْذُ فَارَقْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَشَدَّ عَلَيَّ مِنْ هَذِهِ ، فَأْتُوا غَيْرِي ، فَاخْتَلَفُوا إِلَيْهِ شَهْرًا ، ثُمَّ قَالُوا لَهُ فِي آخِرِ ذَلِكَ : مَنْ نَسْأَلُ إِنْ لَمْ نَسْأَلْكَ ، وَأَنْتَ أُخَيَّةُ أَصْحَابِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فِي هَذِهِ الْبَلْدَةِ ، وَلا نَجْدُ غَيْرَكَ ، فَقَالَ : ابْنُ مَسْعُودٍ : سَأَقُولُ فِيهَا بِجَهْدِ رَأْيِي ، إِنْ كَانَ صَوَابًا فَمِنَ اللَّهِ ، وَإِنْ كَانَ خَطَأً فَمِنِّي ، وَاللَّهُ وَرَسُولُهُ مِنْهُ بَرِيءٌ ، أَرَى أَنْ يُفْرَضَ لَهَا كَصَدَاقِ نِسَائِهَا ، وَلا وَكْسَ ، وَلا شَطَطَ ، وَلَهَا الْمِيرَاثُ ، وَعَلَيْهَا الْعِدَّةُ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا ، وَذَلِكَ بِحَضْرَةِ نَاسٍ مِنْ أَشْجَعَ ، فَقَامَ رَجُلٌ يُقَالُ لَهُ : مَعْقِلُ بْنُ سِنَانٍ الأَشْجَعِيُّ ، فَقَالَ : " أَشْهَدُ أَنَّكَ قَضَيْتَ بِمِثْلِ الَّذِي قَضَى بِهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي امْرَأَةٍ مِنَّا ، يُقَالُ لَهَا : بِرْوَعُ بِنْتُ وَاشِقٍ ، فَمَا رُئِيَ عَبْدُ اللَّهِ فَرِحَ بِشَيْءٍ بَعْدَ الإِسْلامِ كَفَرْحِهِ بِهَذِهِ الْقِصَّةِ " .
Alqamah narrates: Some people came to the service of Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him). They said: We have come to ask you about a man who is related to us. He got married, did not fix a dowry (mahr) for his wife, and Allah Almighty did not give the husband and wife the opportunity to be together until the man passed away. So Sayyiduna Abdullah (may Allah be pleased with him) said: Since I separated from the Prophet (peace and blessings of Allah be upon him), no one has asked me about an issue that is more difficult for me than this. You people should go to someone else. Those people kept coming to Sayyiduna Abdullah (may Allah be pleased with him) for a month. After a month, they said to Sayyiduna Abdullah (may Allah be pleased with him): If we do not ask you, then whom should we ask? In this city, you are the only companion of the Prophet (peace and blessings of Allah be upon him). We find no one else besides you. Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: I will give a verdict on this matter according to my personal opinion. If it is correct, it will be from Allah Almighty, and if it is wrong, it will be from me. Allah and His Messenger are free from responsibility for it. My opinion is that this woman should be given a dowry like that of other women similar to her, with neither any decrease nor any increase, and she should receive a share in inheritance, and it is obligatory for this woman to observe the waiting period (‘iddah) of four months and ten days. (The narrator says) This incident took place in the presence of some people from the Ashja‘ tribe. Then a man stood up, whose name was Ma‘qil bin Sinan Ashja‘i. He said: I bear witness that you have given the same verdict in this matter as the Prophet (peace and blessings of Allah be upon him) gave in a similar case regarding a woman from our (tribe). That woman's name was Barwa‘ bint Washiq. (The narrator says) I have never seen Sayyiduna Abdullah so happy after accepting Islam as he was on this occasion (that his personal opinion matched the verdict of the Prophet, peace and blessings of Allah be upon him).
