Hadith 4089

أَخْبَرَنَا الْحَسَنُ بْنُ سُفْيَانَ ، حَدَّثَنَا حِبَّانُ ، أَخْبَرَنَا عَبْدُ اللَّهِ ، عَنْ مَعْمَرٍ ، حَدَّثَنِي صَالِحُ بْنُ كَيْسَانَ ، عَنْ نَافِعِ بْنِ جُبَيْرٍ ، عَنِ ابْنِ عَبَّاسٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ قَالَ : " لَيْسَ لِوَلِيٍّ مَعَ الثَّيِّبِ أَمْرٌ ، وَالْيَتِيمَةُ تُسْتَأْمَرُ ، وَصَمْتُهَا إِقْرَارُهَا " ، قَالَ أَبُو حَاتِمٍ : قَوْلُهُ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لَيْسَ لِلْوَلِيِّ مَعَ الثَّيِّبِ أَمَرٌ " ، يُبَيِّنُ لَكَ صِحَّةَ مَا ذَهَبْنَا إِلَيْهِ ، أَنَّ الرِّضَا وَالاخْتِيَارَ إِلَى النِّسَاءِ ، وَالْعَقْدُ إِلَى الأَوْلِيَاءِ ، لِنَفْيِهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنِ الْوَلِيِّ انْفِرَادَ الأَمْرِ دُونَهَا إِذَا كَانَتْ ثَيِّبًا ، لأَنَّ لَهَا الْخِيَارَ فِي بِضْعِهَا ، وَالرِّضَا بِمَا يُعْقَدُ عَلَيْهَا ، وَقَوْلُهُ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الْيَتِيمَةُ تُسْتَأْمَرُ " أَرَادَ بِهِ تُسْتَرْضَى فِيمَنْ عُزِمَ لَهُ عَلَى الْعَقْدِ عَلَيْهَا ، فَإِنْ صَمَتَتْ فَهُوَ إِقْرَارُهَا ، ثُمَّ يَتَرَبَّصُ بِالْعَقْدِ إِلَى الْبُلُوغِ ، لأَنَّهَا وَإِنْ صَمَتَتْ وَأَذِنَتْ ، لَيْسَ لَهَا أَمَرٌ وَلا إِذْنٌ ، إِذِ الأَمْرُ وَالإِذْنُ لا يَكُونَا إِلا لِلْبَالِغَةِ .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates this statement of the Prophet (peace and blessings be upon him): "The guardian has no authority regarding a previously married woman, and the consent of a virgin girl will be sought; her silence will be considered her approval." (Imam Ibn Hibban, may Allah have mercy on him, says:) The statement of the Prophet (peace and blessings be upon him), "The guardian has no authority regarding a previously married woman," will clarify before you the correctness of the position to which we adhere: that the matter of consent and choice will be entrusted to women, and the matter of conducting the marriage contract will be entrusted to the guardians, because the Prophet (peace and blessings be upon him) has negated the guardian acting individually in the case of a previously married woman without her consent. The reason for this is: a woman has authority regarding her own marriage, and she has the right to express approval regarding the one with whom her marriage contract is being conducted. The statement of the Prophet (peace and blessings be upon him): "The consent of a virgin girl will be sought," means: her consent will be sought regarding the person with whom it is intended to marry her. If she remains silent, this will be considered her approval. Then the matter of her contract will be kept as such until she reaches maturity. The reason for this is: although she remained silent and gave permission, still she does not have the right to direct or permit, because the right to direct or permit is only possessed by a mature girl.
