Hadith 4049

أَخْبَرَنَا الْحُسَيْنُ بْنُ إِدْرِيسَ الأَنْصَارِيُّ ، قَالَ : أَخْبَرَنَا أَحْمَدُ بْنُ أَبِي بَكْرٍ ، عَنْ مَالِكٍ ، عَنْ عَبْدِ اللَّهِ بْنِ يَزِيدَ مَوْلَى الأَسْوَدِ بْنِ سُفْيَانَ ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ ، عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ ، أَنَّ أَبَا عَمْرِو بْنَ حَفْصٍ طَلَّقَهَا الْبَتَّةَ ، وَهُوَ غَائِبٌ بِالشَّامِ ، فَأَرْسَلَ إِلَيْهَا وَكِيلَهُ بِشَعِيرٍ ، فَسَخِطَتْهُ ، فَقَالَ : وَاللَّهِ مَا لَكَ عَلَيْنَا مِنْ شَيْءٍ ، فَجَاءَتْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَذَكَرَتْ ذَلِكَ لَهُ ، فَقَالَ : " لَيْسَ لَكِ عَلَيْهِ نَفَقَةٌ " ، وَأَمَرَهَا أَنْ تَعْتَدَّ فِي بَيْتِ أُمِّ شَرِيكٍ ، ثُمَّ قَالَ : " تِلْكَ امْرَأَةٌ يَغْشَاهَا أَصْحَابِي ، فَاعْتَدِّي عِنْدَ أُمِّ مَكْتُومٍ ، فَإِنَّهُ رَجُلٌ أَعْمَى ، فَإِذَا حَلَلْتِ فَآذِنِينِي " ، قَالَتْ : فَلَمَّا حَلَلْتُ ذَكَرْتُ لَهُ أَنَّ مُعَاوِيَةَ بْنَ أَبِي سُفْيَانَ ، وَأَبَا جَهْمٍ خَطَبَانِي ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَمَا أَبُو جَهْمٍ فَلا يَضَعُ عَصَاهُ عَنْ عَاتِقِهِ ، وَأَمَّا مُعَاوِيَةُ فَصُعْلُوكٌ لا مَالُ لَهُ ، انْكِحِي أُسَامَةَ بْنَ زَيْدٍ " ، قَالَتْ : فَكَرِهْتُهُ ، ثُمَّ قَالَ : " انْكِحِي أُسَامَةَ " فَنَكَحْتُهُ ، فَجَعَلَ اللَّهُ فِيهِ خَيْرًا ، وَاغْتَبَطْتُ بِهِ .
Lady Fatimah bint Qais (may Allah be pleased with her) narrates: Sayyiduna Abu Amr bin Hafs (may Allah be pleased with him) gave her an irrevocable divorce while he was in Syria. He sent some “barley” through his agent to her. She expressed displeasure to the agent, and the agent said: By Allah! We are not obliged to give you anything else besides this. That lady went to the service of the Prophet (peace and blessings of Allah be upon him) and mentioned this issue before him. The Prophet (peace and blessings of Allah be upon him) said: He is not obliged to provide you with maintenance. Then the Prophet (peace and blessings of Allah be upon him) instructed her to spend her waiting period (‘iddah) at the house of Lady Umm Sharik (may Allah be pleased with her). Then the Prophet (peace and blessings of Allah be upon him) said: She is a woman whom my companions frequently visit; you should spend your ‘iddah at the house of Ibn Umm Maktum, for he is a blind man. When your ‘iddah is over, inform me. Lady Fatimah bint Qais (may Allah be pleased with her) narrates: When my ‘iddah ended, I informed the Prophet (peace and blessings of Allah be upon him) that Muawiyah bin Abu Sufyan and Abu Jahm had sent me marriage proposals. The Prophet (peace and blessings of Allah be upon him) said: As for Abu Jahm, he does not put down his stick from his shoulder (i.e., he beats women), and as for Muawiyah, he is a poor man, he has no wealth. Marry Usamah bin Zaid. Lady Fatimah bint Qais (may Allah be pleased with her) narrates: I did not like him, but then the Prophet (peace and blessings of Allah be upon him) said: Marry Usamah. So I married him, and Allah placed so much goodness in that marriage that people envied me.
