Hadith 3715

أَخْبَرَنَا ابْنُ سَلْمٍ ، قَالَ : حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ إِبْرَاهِيمَ ، قَالَ : حَدَّثَنِي الْوَلِيدُ ، قَالَ : حَدَّثَنَا الأَوْزَاعِيُّ ، قَالَ : حَدَّثَنِي يَحْيَى بْنُ أَبِي كَثِيرٍ ، عَنْ أَبِي سَلَمَةَ ، عَنْ أَبِي هُرَيْرَةَ ، قَالَ : لَمَّا فَتْحَ اللَّهُ جَلَّ وَعَلا عَلَى رَسُولِهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَكَّةَ ، قَتَلَتْ هُذَيْلُ رَجُلا مِنْ بَنِي لَيْثٍ بِقَتِيلٍ كَانَ لَهُمْ فِي الْجَاهِلِيَّةِ ، فَبَلَغَ ذَلِكَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَامَ ، فَقَالَ : " إِنَّ اللَّهَ جَلَّ وَعَلا حَبَسَ الْفِيلَ عَنْ مَكَّةَ ، وَسَلَّطَ عَلَيْهَا رَسُولَهُ وَالْمُؤْمِنِينَ ، وَإِنَّهَا لا تَحِلُّ لأَحَدٍ كَانَ قَبْلِي ، وَلا تَحِلُّ لأَحَدٍ بَعْدِي ، وَإِنَّمَا أُحِلَّتْ لِي سَاعَةً مِنْ نَهَارٍ ، وَإِنَّهَا سَاعَتِي هَذِهِ ، ثُمَّ هِيَ حَرَامٌ ، لا يُعْضَدُ شَجَرُهَا ، وَلا يُخْتَلَى شَوْكُهَا ، وَلا يُلْتَقَطُ سَاقِطُهَا إِلا لِمُنْشِدٍ ، وَمَنْ قُتِلَ لَهُ قَتِيلٌ ، فَهُوَ بِخَيْرِ النَّظَرَيْنِ ، إِمَّا أَنْ يَقْتُلَ ، وَإِمَّا أَنْ يَفْدِيَ " ، فَقَامَ رَجُلٌ مِنَ الْيَمَنِ يُقَالُ لَهُ : أَبُو شَاهٍ ، فَقَالَ : يَا رَسُولَ اللَّهِ ، اكْتُبُوا لِي ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " اكْتُبُوا لأَبِي شَاهٍ " ، ثُمَّ قَامَ الْعَبَّاسُ ، فَقَالَ : يَا رَسُولَ اللَّهِ ، إِلا الإِذْخِرَ ، فَإِنَّا نَجْعَلُهُ فِي قُبُورِنَا ، وَفِي بُيُوتِنَا ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِلا الإِذْخِرَ " .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates: When Allah Almighty granted His Messenger the conquest of Makkah, the tribe of Hudhail killed a man from Banu Lais in retaliation for one of their slain. This was an affair from the time of ignorance. News of this reached the Prophet (peace and blessings be upon him). He stood up and said: Indeed, Allah Almighty did not allow the elephants to reach Makkah, but He granted His Messenger and the believers dominance over it. It was not made lawful for anyone before me, nor will it be lawful for anyone after me. It was made lawful for me only for a specific portion of the day, and now after this hour, it is sacred. Its trees are not to be cut, its thorns are not to be broken, and its fallen things are not to be picked up, except by one who announces it. Whoever has a relative killed has the choice of two things: either to kill (the murderer) or to accept blood money. (The narrator says:) A man from Yemen stood up whose name was Abu Shah. He said: O Messenger of Allah! Write this down for me. The Prophet (peace and blessings be upon him) said: Write it down for Abu Shah. Then Sayyiduna Abbas (may Allah be pleased with him) stood up and said: O Messenger of Allah (peace and blessings be upon him)! Allow only the cutting of idhkhir (a type of grass), for we use it in our graveyards and in our homes. The Prophet (peace and blessings be upon him) said: Idhkhir (the ruling is different, i.e., its cutting is permitted).
