Drawing Lots Between Two Oath-Takers

Hadith 97

قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِذَا أُكْرِهَ الاثْنَانِ عَلَى الْيَمِينِ فَاسْتَحَبَّاهَا، فَأَسْهِمْ بَيْنَهُمَا "
And the Messenger of Allah, peace and blessings be upon him, said: "When two men are compelled to take an oath and both of them prefer to take the oath, then cast lots between them."

Hadith Takhrij «صحيح بخاري، كتاب الشهادات، باب إذا تسارع قوم فى اليمين، رقم: 2674 - سنن أبو داؤد، كتاب الأقضية، باب الرجلين يدعيان شيئا وليس لهما بينة، رقم: 3616، حدثنا أحمد بن حنبل، وسلمة بن شبيب، قالا: حدثنا عبدالرزاق: أخبرنا معمر، عن همام بن منبه، عن أبى هريرة، عن النبى صلى الله عليه وسلم قال: .... وذكر أن رواية سلمة: ”إذا أكره“ - مسند أحمد 89/16، رقم: 100/8194 - سنن الكبرىٰ، كتاب الدعوىٰ والبينات، باب المتداعيين يتنازعان المال: 255/10 - مصنف عبدالرزاق، باب الرجلين يدعيان السلعة يقيم كل واحد منهما البينة: 279/8 - شرح السنة، كتاب الإمارة والقضاء، باب إذا توجه اليمين على جماعة بقرع بينهم: 109/10.»

Abu Dawud — Hadith 3617
Abu Hurairah reported the holy prophet ﷺ as saying: When two men dislike the oath or like it, lots will be cost about it. Salamah said on the authority of Mamar who said: when the two are compelled to take an oath.

Benefits and Issues:
Benefit: That is, when neither of the two wishes to take an oath, then the judge can decide that a lot should be drawn, and whoever's name is drawn will have to take the oath, or else he will withdraw.
