Hadith 94

قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِنِّي لأَنْقَلِبُ إِلَى أَهْلِي فَأَجِدُ التَّمْرَةَ سَاقِطَةً عَلَى فِرَاشِي أَوْ فِي بَيْتِي فَأَرْفَعُهَا لآكُلَهَا، ثُمَّ أَخْشَى أَنْ تَكُونَ مِنَ الصَّدَقَةِ، فَأُلْقِيهَا "
And the Messenger of Allah, peace and blessings be upon him, said: "When I return to my house, I find a date lying on my bed (in my house), and I pick it up to eat it, but then, fearing that it might be from charity, I throw it away."

Hadith Commentary:

It is understood from this that if a trivial thing is found on the road or in the house, it is permissible to eat it.
It is not necessary to search for the owner of such an item or to make an announcement regarding it.
The reason why the Messenger of Allah (sallallahu alayhi wa sallam) refrained from eating such a date was not because the rulings of luqatah (lost property) apply to it, but rather because it might have been charity, and charity was forbidden for him.

When Maymunah (radi Allahu anha) saw a fallen date, she picked it up and ate it, and said:
“Allah does not like corruption.”

Under this hadith, Hafiz Ibn Hajar (rahimahullah) writes that if Maymunah (radi Allahu anha) had ignored it and no one else had picked it up, it would have remained there and become spoiled.
Thus, to spoil something without reason is not liked by Allah, which is why she picked up the date and ate it.

It is mentioned in al-Musannaf ‘Abd al-Razzaq that Ali (radi Allahu anhu) found a pomegranate lying on the road, so he picked it up and ate it.

Similarly, Ibn ‘Umar (radi Allahu anhu) saw a fallen date, split it into two parts, ate one himself, and gave the other part to a poor person.
