Cases Where Qisas (Retaliation) and Compensation Are Not Taken
Hadith 138
قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الْعَجْمَاءُ جَرْحُهَا جُبَارٌ، وَالْبِئْرُ جُبَارٌ، وَالْمَعْدِنُ جُبَارٌ، وَالنَّارُ جُبَارٌ، وَفِي الرِّكَازِ الْخُمُسُ "
And the Messenger of Allah, peace and blessings be upon him, said: "There is no compensation for an animal that is wounded (or killed), for falling into a well and being injured, nor for dying by falling into fire. And one-fifth of the buried treasure (is for Allah and His Messenger, peace and blessings be upon him)."
