Hadith 1409
وحَدَّثَنِي أَبُو غَسَّانَ الْمِسْمَعِيُّ ، حدثنا عَبْدُ الْأَعْلَى . ح وحَدَّثَنِي أَبُو الْخَطَّابِ زِيَادُ بْنُ يَحْيَى ، حدثنا مُحَمَّدُ بْنُ سَوَاءٍ ، قَالَا جَمِيعًا : حدثنا سَعِيدٌ ، عَنْ مَطَرٍ ، وَيَعْلَى بْنِ حَكِيمٍ ، عَنْ نَافِعٍ ، عَنْ نُبَيْهِ بْنِ وَهْبٍ ، عَنْ أَبَانَ بْنِ عُثْمَانَ ، عَنْ عُثْمَانَ بْنِ عَفَّانَ : أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّم ، قَالَ : " لَا يَنْكِحُ الْمُحْرِمُ ، وَلَا يُنْكَح ، ولَا يَخْطُبُ " .
'Uthman bin 'Affan reported that Allah's Messenger (ﷺ) had said: A Muhrim should neither marry himself, nor should he be got married to anyone, nor should he make the proposal of marriage.
Hadith 1473
وحدثنا زُهَيْرُ بْنُ حَرْبٍ ، حدثنا إِسْمَاعِيل بْنُ إِبْرَاهِيمَ ، عَنْ هِشَامٍ يَعْنِي الدَّسْتَوَائِيَّ ، قَالَ : كَتَبَ إِلَيَّ يَحْيَى بْنُ أَبِي كَثِيرٍ ، يُحَدِّثُ ، عَنْ يَعْلَى بْنِ حَكِيمٍ ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ ، عَنِ ابْنِ عَبَّاسٍ ، أَنَّهُ كَانَ يَقُولُ : " فِي الْحَرَامِ يَمِينٌ يُكَفِّرُهَا ، وَقَالَ ابْنُ عَبَّاسٍ : لَقَدْ كَانَ لَكُمْ فِي رَسُولِ اللَّهِ أُسْوَةٌ حَسَنَةٌ سورة الأحزاب آية 21 " .
Ibn Abbas (RA) reported about (declaring of one's woman) unlawful as an oath which must be atoned, and Ibn 'Abbas said: Verily, there is in the Messenger of Allah (ﷺ) a model pattern for you.
Hadith 1473
حدثنا يَحْيَى بْنُ بِشْرٍ الْحَرِيرِيُّ ، حدثنا مُعَاوِيَةُ يَعْنِي ابْنَ سَلَّامٍ ، عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ ، أَنَّ يَعْلَى بْنَ حَكِيمٍ ، أَخْبَرَهُ : أَنَّ سَعِيدَ بْنَ جُبَيْرٍ ، أَخْبَرَهُ : أَنَّهُ سَمِعَ ابْنَ عَبَّاسٍ ، قَالَ : " إِذَا حَرَّمَ الرَّجُلُ عَلَيْهِ امْرَأَتَهُ فَهِيَ يَمِينٌ يُكَفِّرُهَا ، وَقَالَ : لَقَدْ كَانَ لَكُمْ فِي رَسُولِ اللَّهِ أُسْوَةٌ حَسَنَةٌ سورة الأحزاب آية 21 " .
Ibn Abbas (RA) reported: When a man declares his wife unlawful for himself that is an oath which must be atoned, and he said: There is in the Messenger of Allah (ﷺ) a noble pattern for you.
Hadith 1548
وحَدَّثَنِي عَلِيُّ بْنُ حُجْرٍ السَّعْدِيُّ ، وَيَعْقُوبُ بْنُ إِبْرَاهِيمَ ، قَالَا : حَدَّثَنَا إِسْمَاعِيلُ وَهُوَ ابْنُ عُلَيَّةَ ، عَنْ أَيُّوبَ ، عَنْ يَعْلَى بْنِ حَكِيمٍ ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ ، عَنْ رَافِعِ بْنِ خَدِيجٍ ، قَالَ : كُنَّا نُحَاقِلُ الْأَرْضَ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَنُكْرِيهَا بِالثُّلُثِ ، وَالرُّبُعِ ، وَالطَّعَامِ الْمُسَمَّى ، فَجَاءَنَا ذَاتَ يَوْمٍ رَجُلٌ مَنْ عُمُومَتِي ، فَقَالَ : " نَهَانَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ أَمْرٍ كَانَ لَنَا نَافِعًا وَطَوَاعِيَةُ اللَّهِ وَرَسُولِهِ أَنْفَعُ لَنَا ، نَهَانَا أَنْ نُحَاقِلَ بِالْأَرْضِ ، فَنُكْرِيَهَا عَلَى الثُّلُثِ ، وَالرُّبُعِ ، وَالطَّعَامِ الْمُسَمَّى ، وَأَمَرَ رَبَّ الْأَرْضِ أَنْ يَزْرَعَهَا ، أَوْ يُزْرِعَهَا ، وَكَرِهَ كِرَاءَهَا وَمَا سِوَى ذَلِكَ " .
Rafi bin Khadij (RA) reported: We used to give on rent land during the lifetime of Allah's Messenger (ﷺ) . We rented it on the share of one-third or one-fourth of the (produce) along with a definite quantity of corn. One day a person from among my uncles came to us and said: Allah's Messenger (ﷺ) forbade us this act which was a source of benefit to us, but the obedience to Allah and to His Messenger (ﷺ) is more beneficial to us. He forbade us that we should rent land with one-third or one-fourth of (the produce) and the corn of a measure, and he commanded the owner of land that he should cultivate it or let it be cultivated by other (persons) but he showed disapproval of renting it or anything besides it.
Hadith 1548
وحَدَّثَنَاه يَحْيَى بْنُ يَحْيَى ، أَخْبَرَنَا حَمَّادُ بْنُ زَيْدٍ ، عَنْ أَيُّوبَ ، قَالَ : كَتَبَ إِلَيَّ يَعْلَى بْنُ حَكِيمٍ ، قَالَ : سَمِعْتُ سُلَيْمَانَ بْنَ يَسَارٍ ، يُحَدِّثُ عَنْ رَافِعِ بْنِ خَدِيجٍ ، قَالَ : كُنَّا نُحَاقِلُ بِالْأَرْضِ ، فَنُكْرِيهَا عَلَى الثُّلُثِ ، وَالرُّبُعِ ، ثُمَّ ذَكَرَ بِمِثْلِ حَدِيثِ ابْنِ عُلَيَّةَ .
Rafi bin Khadij (RA) reported: We used to give land on rent, and we rented it on one-third or one-fourth share. The rest of the hadith is the same.
Hadith 1548
وحَدَّثَنَا يَحْيَى بْنُ حَبِيبٍ ، حَدَّثَنَا خَالِدُ بْنُ الْحَارِثِ . ح وحَدَّثَنَا عَمْرُو بْنُ عَلِيٍّ ، حَدَّثَنَا عَبْدُ الْأَعْلَى . ح وحَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ ، أَخْبَرَنَا عَبْدَةُ ، كُلُّهُمْ عَنْ ابْنِ أَبِي عَرُوبَةَ ، عَنْ يَعْلَى بْنِ حَكِيمٍ ، بِهَذَا الْإِسْنَادِ مِثْلَهُ ،
Another chain narrated the same as the above hadith.
Hadith 1548
وحَدَّثَنِيهِ أَبُو الطَّاهِرِ ، أَخْبَرَنَا ابْنُ وَهْبٍ ، أَخْبَرَنِي جَرِيرُ بْنُ حَازِمٍ ، عَنْ يَعْلَى بْنِ حَكِيمٍ ، بِهَذَا الْإِسْنَادِ ، عَنْ رَافِعِ بْنِ خَدِيجٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَلَمْ يَقُلْ : عَنْ بَعْضِ عُمُومَتِهِ .
This hadith has been narrated on the authority of Rafi' bin Khadij with the same chain of transmitters, but in it no mention is made of some of his uncles.
Hadith 1997
حَدَّثَنَا شَيْبَانُ بْنُ فَرُّوخَ ، حَدَّثَنَا جَرِيرٌ يَعْنِي ابْنَ حَازِمٍ ، حَدَّثَنَا يَعْلَى بْنُ حَكِيمٍ ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ ، قَالَ : سَأَلْتُ ابْنَ عُمَرَ عَنْ نَبِيذِ الْجَرِّ ، فَقَالَ : حَرَّمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَبِيذَ الْجَرِّ ، فَأَتَيْتُ ابْنَ عَبَّاسٍ ، فَقُلْتُ : أَلَا تَسْمَعُ مَا يَقُولُ ابْنُ عُمَر َ ؟ ، قَالَ : وَمَا يَقُولُ ؟ قُلْتُ : قَالَ : حَرَّمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَبِيذَ الْجَرِّ ، فَقَالَ : " صَدَقَ ابْنُ عُمَرَ حَرَّمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَبِيذَ الْجَرِّ ، فَقُلْتُ : وَأَيُّ شَيْءٍ نَبِيذُ الْجَرِّ ؟ ، فَقَالَ : كُلُّ شَيْءٍ يُصْنَعُ مِنَ الْمَدَرِ " .
Sa'id bin Jubair reported: I asked Ibn 'Umar about (the preparation of) Nabidh in a green pitcher (besmeared with pitch), whereupon he said that Allah's Messenger (ﷺ) forbade the (preparation of) Nabidh in green pitcher (besmeared with pitch). I then came to Ibn Abbas (RA) and said: Do you hear what Ibn 'Umar has said? Thereupon he said: What does he say? I said: He stated that Allah's Messenger (ﷺ) has forbidden the (preparation of) Nabidh in a green pitcher (besmeared with pitch), whereupon he said: Ibn 'Umar has told the truth. Allah's Messenger (ﷺ) declared unlawful the preparation of Nabidh in a green pitcher (besmeared with pitch). I said: What is this thing, the Nabidh of a pitcher (Nabidh prepared in a pitcher)? Thereupon, he said: Everything that is prepared in earthen pitcher.
