Hadith 139
حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ ، وَأَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، وَهَنَّادُ بْنُ السَّرِيِّ ، وَأَبُو عاصم الحنفي وَاللَّفْظُ لِقُتَيْبَةَ ، قَالُوا : حَدَّثَنَا أَبُو الأَحْوَصِ ، عَنْ سِمَاكٍ ، عَنْ عَلْقَمَةَ بْنِ وَائِلٍ ، عَنْ أَبِيهِ ، قَالَ : جَاءَ رَجُلٌ مِنْ حَضْرَمَوْتَ ، وَرَجُلٌ مِنْ كِنْدَةَ ، إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ الْحَضْرَمِيُّ : يَا رَسُولَ اللَّهِ ، إِنَّ هَذَا قَدْ غَلَبَنِي عَلَى أَرْضٍ لِي ، كَانَتْ لِأَبِي ، فَقَالَ الْكِنْدِيُّ : هِيَ أَرْضِي فِي يَدِي ، أَزْرَعُهَا لَيْسَ لَهُ فِيهَا حَقٌّ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِلْحَضْرَمِيِّ : أَلَكَ بَيِّنَةٌ ؟ قَالَ : لَا ، قَالَ : فَلَكَ يَمِينُهُ ؟ قَالَ : يَا رَسُولَ اللَّهِ ، إِنَّ الرَّجُلَ فَاجِرٌ لَا يُبَالِي عَلَى مَا حَلَفَ عَلَيْهِ ، وَلَيْسَ يَتَوَرَّعُ مِنْ شَيْءٍ ، فَقَالَ : لَيْسَ لَكَ مِنْهُ إِلَّا ذَلِك ؟ فَانْطَلَقَ لِيَحْلِفَ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَمَّا أَدْبَرَ : " أَمَا لَئِنْ حَلَفَ عَلَى مَالِهِ لِيَأْكُلَهُ ظُلْمًا ، لَيَلْقَيَنَّ اللَّهَ وَهُوَ عَنْهُ مُعْرِضٌ " .
It is narrated on the authority of Wa'il that there came a person from Hadramaut and another one from Kinda to the Apostle (ﷺ) . One who had come from Hadramaut said: Messenger of Allah, only this man has appropriated my land which belonged to my father. The one who had came from Kinda contended. This is my land and is in my possession: I cultivate it. There is no right for him in it. The Messenger of Allah (ﷺ) said to the Hadramite: Have you any evidence (to support you)? He replied in the negative. He (the Apostle of Allah (ﷺ) ) said: Then your case is to be decided on his oath. He (the Hadramite) said: Messenger of Allah, he is a liar and cares not what he swears and has no regard for anything. Upon this he (the Messenger of Allah) (ﷺ) remarked: For you then there is no other help to it. He (the man from Kinda) set out to take an oath. When he turned his back the Messenger of Allah (ﷺ) observed: If he took an oath on his property with a view to usurping it, he would certainly meet his Lord in a state that He would turn away from him.

Hadith 139
وحَدَّثَنِي زُهَيْرُ بْنُ حَرْبٍ ، وَإِسْحَاق بْنُ إِبْرَاهِيمَ جميعا ، عَنْ أَبِي الْوَلِيدِ ، قَالَ زُهَيْرٌ : حَدَّثَنَا هِشَامُ بْنُ عَبْدِ الْمَلِكِ ، حَدَّثَنَا أَبُو عَوَانَةَ ، عَنْ عَبْدِ الْمَلِكِ بْنِ عُمَيْرٍ ، عَنْ عَلْقَمَةَ بْنِ وَائِلٍ ، عَنْ وَائِلِ بْنِ حُجْرٍ ، قَالَ : كُنْتُ عِنْدَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَأَتَاهُ رَجُلَانِ يَخْتَصِمَانِ فِي أَرْضٍ ، فَقَالَ أَحَدُهُمَا : إِنَّ هَذَا انْتَزَى عَلَى أَرْضِي يَا رَسُولَ اللَّهِ فِي الْجَاهِلِيَّةِ ، وَهُوَ امْرُؤُ الْقَيْسِ بْنُ عَابِسٍ الْكِنْدِيُّ ، وَخَصْمُهُ رَبِيعَةُ بْنُ عِبْدَانَ ، قَالَ : بَيِّنَتُكَ ؟ قَالَ : لَيْسَ لِي بَيِّنَةٌ ، قَالَ : يَمِينُهُ ؟ قَالَ : إِذًا يَذْهَبُ بِهَا ، قَالَ : لَيْسَ لَكَ إِلَّا ذَاكَ ، قَالَ : فَلَمَّا قَامَ لِيَحْلِفَ ، قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنِ اقْتَطَعَ أَرْضًا ظَالِمًا ، لَقِيَ اللَّهَ وَهُوَ عَلَيْهِ غَضْبَانُ " ، قَالَ إِسْحَاق فِي رِوَايَتِهِ رَبِيعَةُ بْنُ عَيْدَانَ .
Wa'il reported it on the authority of his father Hujr: I was with the Messenger of Allah (ﷺ) that two men came there disputing over a piece of land. One of them said: Messenger of Allah, this man appropriated my land without justification in the days of ignorance. The (claimant) was Imru'l-Qais bin 'Abis al-Kindi and his opponent was Rabi'a bin 'Iban He (the Holy Prophet) said (to the claimant): Have you evidence (to substantiate your claim)? He replied: I have no evidence. Upon this he (the Messenger of Allah) (ﷺ) remarked: Then his (that is of the defendant) is the oath. He (the claimant) said: In this case he (the defendant) would appropriate this (the property). He (the Holy Prophet) said: There is than no other way left for you but this. He (the narrator) said: When he (the defendant) stood up to take oath, the Messenger of Allah (ﷺ) said: He who appropriated the land wrongfully would meet Allah in a state that He would be angry with him. Ishaq in his narration mentions Rabi'a bin 'Aidan (instead of Rabi'a bin 'Ibdan).

Hadith 401
حَدَّثَنَا زُهَيْرُ بْنُ حَرْبٍ ، حَدَّثَنَا عَفَّانُ ، حَدَّثَنَا هَمَّامٌ ، حَدَّثَنَا مُحَمَّدُ بْنُ جُحَادَةَ ، حَدَّثَنِي عَبْدُ الْجَبَّارِ بْنُ وَائِلٍ ، عَنْ عَلْقَمَةَ بْنِ وَائِلٍ وَمَوْلًى لهم ، أنهما حدثاه ، عَنْ أَبِيهِ وَائِلِ بْنِ حُجْرٍ ، " أَنَّهُ رَأَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، رَفَعَ يَدَيْهِ حِينَ دَخَلَ فِي الصَّلَاةِ كَبَّرَ ، وَصَفَ هَمَّامٌ حِيَالَ أُذُنَيْهِ ، ثُمَّ الْتَحَفَ بِثَوْبِهِ ، ثُمَّ وَضَعَ يَدَهُ الْيُمْنَى عَلَى الْيُسْرَى ، فَلَمَّا أَرَادَ أَنْ يَرْكَعَ ، أَخْرَجَ يَدَيْهِ مِنَ الثَّوْبِ ، ثُمَّ رَفَعَهُمَا ، ثُمَّ كَبَّرَ فَرَكَعَ ، فَلَمَّا قَالَ : سَمِعَ اللَّهُ لِمَنْ حَمِدَهُ ، رَفَعَ يَدَيْهِ ، فَلَمَّا سَجَدَ ، سَجَدَ بَيْنَ كَفَّيْهِ " .
Wa'il bin Hujr reported: He saw the Apostle of Allah (ﷺ) raising his hands at the time of beginning the prayer and reciting takbir, and according to Hammam (the narrator), the hands were lifted opposite to ears. He (the Holy Prophet) then wrapped his hands in his cloth and placed his right hand over his left hand. And when he was about to bow down, he brought out his hands from the cloth, and then lifted them, and then recited takbir and bowed down, and when (he came back to the erect position) he recited: "Allah listened to him who praised Him." And when prostrates, he prostrated between the two palms.

حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ مُعَاذٍ الْعَنْبَرِيُّ ، حَدَّثَنَا أَبِي ، حَدَّثَنَا أَبُو يُونُسَ ، عَنْ سِمَاكِ بْنِ حَرْبٍ ، أَنَّ عَلْقَمَةَ بْنَ وَائِلٍ حَدَّثَهُ : أَنَّ أَبَاهُ حَدَّثَهُ ، قَالَ : " إِنِّي لَقَاعِدٌ مَعَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِذْ جَاءَ رَجُلٌ يَقُودُ آخَرَ بِنِسْعَةٍ ، فَقَالَ : يَا رَسُولَ اللَّهِ ، هَذَا قَتَلَ أَخِي ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : أَقَتَلْتَهُ ، فَقَالَ : إِنَّهُ لَوْ لَمْ يَعْتَرِفْ أَقَمْتُ عَلَيْهِ الْبَيِّنَةَ ؟ ، قَالَ : نَعَمْ قَتَلْتَهُ ، قَالَ : كَيْفَ قَتَلْتَهُ ؟ ، قَالَ : كُنْتُ أَنَا وَهُوَ نَخْتَبِطُ مِنْ شَجَرَةٍ ، فَسَبَّنِي ، فَأَغْضَبَنِي ، فَضَرَبْتُهُ بِالْفَأْسِ عَلَى قَرْنِهِ فَقَتَلْتُهُ ، فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : هَلْ لَكَ مِنْ شَيْءٍ تُؤَدِّيهِ عَنْ نَفْسِكَ ؟ ، قَالَ : مَا لِي مَالٌ إِلَّا كِسَائِي وَفَأْسِي ، قَالَ : فَتَرَى قَوْمَكَ يَشْتَرُونَكَ ؟ ، قَالَ : أَنَا أَهْوَنُ عَلَى قَوْمِي مِنْ ذَاكَ ، فَرَمَى إِلَيْهِ بِنِسْعَتِهِ ، وَقَالَ : دُونَكَ صَاحِبَكَ ، فَانْطَلَقَ بِهِ الرَّجُلُ ، فَلَمَّا وَلَّى قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : إِنْ قَتَلَهُ فَهُوَ مِثْلُهُ ، فَرَجَعَ فَقَالَ : يَا رَسُولَ اللَّهِ ، إِنَّهُ بَلَغَنِي أَنَّكَ قُلْتَ إِنْ قَتَلَهُ فَهُوَ مِثْلُهُ ، وَأَخَذْتُهُ بِأَمْرِكَ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : أَمَا تُرِيدُ أَنْ يَبُوءَ بِإِثْمِكَ وَإِثْمِ صَاحِبِكَ ؟ ، قَالَ : يَا نَبِيَّ اللَّهِ ، لَعَلَّهُ ، قَالَ : بَلَى ، قَالَ : فَإِنَّ ذَاكَ كَذَاكَ " ، قَالَ : فَرَمَى بِنِسْعَتِهِ وَخَلَّى سَبِيلَهُ .
'Alqama bin Wa'il reported on the authority of his-father: While I was sitting in the company of Allah's Apostle (ﷺ) , a person came there dragging another one with the help of a strap and said: Allah's Messenger, this man has killed my brother. Allah's Messenger (ﷺ) said to him: Did you kill him? And the other man said: (In case he did not make a confession of this, I shall bring a witness against him). He (the murderer) said: Yes, I have killed him. He (the Holy Prophet) said: Why did you kill him? He said: I and he were striking down the leaves of a tree and he abused me and enraged me, and to I struck his head with an axe and killed him, whereupon Allah's Messenger (ﷺ) said: Have you anything with you to pay blood-wit on your behalf? He said: I do not possess any property but this robe of mine and this axe of mine. He (the Holy, Prophet) said: Do you think your people will pay ransom for you? He said: I am more insignificant among my people than this (that I would not be able to get this benefit from my tribe). He (the Holy Prophet) threw the strap towards him (the claimant of the blood-wit) saying: Take away your man. The man took him away, and as he returned, Allah's Messenger (ﷺ) said: If he kills him, he will be like him. He returned and said: Allah's Messenger, it has reached me that you have said that "If he killed him, he would be like him." I caught hold of him according to your command, whereupon Allah's Messenger (ﷺ) said: Don't you like that he should take upon him (the burden) of your sin and the sin of your companion (your brother)? He said: Allah's Apostle, why not? The Messenger of Allah (ﷺ) said: If it is so, then let it be. He threw away the strap (around the offender) and set him free.

وحَدَّثَنِي مُحَمَّدُ بْنُ حَاتِمٍ ، حَدَّثَنَا سَعِيدُ بْنُ سُلَيْمَانَ ، حَدَّثَنَا هُشَيْمٌ ، أَخْبَرَنَا إِسْمَاعِيلُ بْنُ سَالِمٍ ، عَنْ عَلْقَمَةَ بْنِ وَائِلٍ ، عَنْ أَبِيهِ ، قَالَ : " أُتِيَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِرَجُلٍ قَتَلَ رَجُلًا ، فَأَقَادَ وَلِيَّ الْمَقْتُولِ مِنْهُ ، فَانْطَلَقَ بِهِ ، وَفِي عُنُقِهِ نِسْعَةٌ يَجُرُّهَا ، فَلَمَّا أَدْبَرَ ، قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : الْقَاتِلُ وَالْمَقْتُولُ فِي النَّارِ " ، فَأَتَى رَجُلٌ الرَّجُلَ ، فَقَالَ لَهُ : مَقَالَةَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَخَلَّى عَنْهُ ، قَالَ إِسْمَاعِيلُ بْنُ سَالِمٍ : فَذَكَرْتُ ذَلِكَ لِحَبِيبِ بْنِ أَبِي ثَابِتٍ ، فَقَالَ : حَدَّثَنِي ابْنُ أَشْوَعَ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِنَّمَا سَأَلَهُ أَنْ يَعْفُوَ عَنْهُ فَأَبَى .
'Alaqama bin Wa'il reported on the authority of his father that a person was brought to the Messenger of Allah (ﷺ) who had killed another person, and the heir of the person slain had dragged him (to the Holy Prophet) with a strap around his neck. As he turned away Allah's Messenger (ﷺ) said: The killer and the killed are (doomed) to fire. A person came to the other person (the heir of the deceased) and he reported to him the words of the Messenger of Allah (ﷺ) , and so he let him off. Isma'il bin Salim said: I made a mention of it to Habib bin Abu Thabit and he said: Ibn Ashwa' reported to me that Allah's Apostle (ﷺ) had asked him to pardon him, but he refused.

حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى ، وَمُحَمَّدُ بْنُ بَشَّارٍ ، قَالَا : حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ ، حَدَّثَنَا شُعْبَةُ ، عَنْ سِمَاكِ بْنِ حَرْبٍ ، عَنْ عَلْقَمَةَ بْنِ وَائِلٍ الْحَضْرَمِيِّ ، عَنْ أَبِيهِ ، قَالَ : " سَأَلَ سَلَمَةُ بْنُ يَزِيدَ الْجُعْفِيُّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : يَا نَبِيَّ اللَّهِ ، أَرَأَيْتَ إِنْ قَامَتْ عَلَيْنَا أُمَرَاءُ يَسْأَلُونَا حَقَّهُمْ وَيَمْنَعُونَا حَقَّنَا فَمَا تَأْمُرُنَا ، فَأَعْرَضَ عَنْهُ ؟ ، ثُمَّ سَأَلَهُ ، فَأَعْرَضَ عَنْهُ ؟ ، ثُمَّ سَأَلَهُ فِي الثَّانِيَةِ أَوْ فِي الثَّالِثَةِ ، فَجَذَبَهُ الْأَشْعَثُ بْنُ قَيْسٍ ، وَقَالَ : اسْمَعُوا وَأَطِيعُوا فَإِنَّمَا عَلَيْهِمْ مَا حُمِّلُوا وَعَلَيْكُمْ مَا حُمِّلْتُمْ " ،
It has been narrated on the authority of Alqama bin Wai'l al-Hadrami who learnt the tradition from his father. The latter said: Salama bin Yazid al-ju'afi asked the Messenger of Allah (ﷺ) : Prophet (ﷺ) of Allah, what do you think if we have rulers who rule over us and demand that we discharge our obligations towards them, but they (themselves) do not discharge their own responsibilities towards us? What do you order us to do? The Messenger of Allah (ﷺ) avoided giving any answer. Salama asked him again. He (again) avoided giving any answer. Then he asked again-it was the second time or the third time-when Ash'ath bin Qais (finding that the Holy Prophet (ﷺ) was unnecessarily being pressed for answer) pulled him aside and said: Listen to them and obey them, for on them shall he their burden and on you shall be your burden.

حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى ، وَمُحَمَّدُ بْنُ بَشَّارٍ ، وَاللَّفْظُ لِابْنِ الْمُثَنَّى ، قَالَا : حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ ، حَدَّثَنَا شُعْبَةُ ، عَنْ سِمَاكِ بْنِ حَرْبٍ ، عَنْ عَلْقَمَةَ بْنِ وَائِلٍ ، عَنْ أَبِيهِ وَائِلٍ الْحَضْرَمِيِّ ، أَنَّ طَارِقَ بْنَ سُوَيْدٍ الْجُعْفِيَّ سَأَلَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنِ الْخَمْرِ فَنَهَاهُ أَوْ كَرِهَ أَنْ يَصْنَعَهَا ، فَقَالَ : إِنَّمَا أَصْنَعُهَا لِلدَّوَاءِ ، فَقَالَ : " إِنَّهُ لَيْسَ بِدَوَاءٍ وَلَكِنَّهُ دَاءٌ " .
Wa'il al-Hadrami reported that Tariq bin Suwaid a-Ju'fi asked Allah's Apostle (ﷺ) about liquor. He forbade (its use) and he expressed hatred that it should be prepared. He (Tariq) said: I prepare it as a medicine, whereupon he (the Holy Prophet) said: It is no medicine, but an ailment.

Hadith 2248
حَدَّثَنَا عَلِيُّ بْنُ خَشْرَمٍ ، أَخْبَرَنَا عِيسَى يَعْنِي ابْنَ يُونُسَ ، عَنْ شُعْبَةَ ، عَنْ سِمَاكِ بْنِ حَرْبٍ ، عَنْ عَلْقَمَةَ بْنِ وَائِلٍ ، عَنْ أَبِيهِ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لَا تَقُولُوا : الْكَرْمُ ، وَلَكِنْ قُولُوا : الْحَبْلَةُ يَعْنِي الْعِنَبَ .
'Alqama bin Wa'il reported, from his father, Allah's Apostle (ﷺ) having said: Do not say al-karm (for the word vine) but say al-habala (that is grape).

Hadith 2248
وحَدَّثَنِيهِ زُهَيْرُ بْنُ حَرْبٍ ، حَدَّثَنَا عُثْمَانُ بْنُ عُمَرَ ، حَدَّثَنَا شُعْبَةُ ، عَنْ سِمَاكٍ ، قَالَ : سَمِعْتُ عَلْقَمَةَ بْنَ وَائِلٍ ، عَنْ أَبِيهِ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لَا تَقُولُوا : الْكَرْمُ ، وَلَكِنْ قُولُوا : الْعِنَبُ وَالْحَبْلَةُ " .
This hadith has been reported by Alqama bin Wa'il on the authority of his father with a different chain of transmitters and with a slight variation of wording.
