حدثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، حدثنا ابْنُ فُضَيْلٍ . ح وحدثنا أَبُو كُرَيْبٍ ، حدثنا أَبُو مُعَاوِيَةَ ، جَمِيعًا ، عَنْ هِشَامٍ ، بِهَذَا الْإِسْنَادِ .

وَحَدَّثَنَاهُ أَبُو كُرَيْبٍ حدثنا أَبُو أُسَامَةَ . ح وحَدَّثَنِي أَبُو مَعْمَرٍ إِسْمَاعِيل بْنُ إِبْرَاهِيمَ الْهُذَلِيُّ ، حدثنا عَلِيُّ بْنُ هَاشِمِ بْنِ الْبَرِيدِ ، جَمِيعًا عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي بَكْرٍ ، عَنْ عَمْرَةَ ، عَنْ عَائِشَةَ ، قَالَت : قَالَ لِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " يَحْرُمُ مِنَ الرَّضَاعَةِ مَا يَحْرُمُ مِنَ الْوِلَادَةِ " .
'A'isha (Allah be pleased with her) reported Allah's Messenger (ﷺ) as saying: Fosterage makes unlawful what consanguinity makes unlawful.

وحدثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، وَأَبُو كُرَيْبٍ ، قَالَا : حدثنا ابْنُ نُمَيْرٍ ، عَنْ هِشَامٍ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ ، قَالَت : جَاءَ عَمِّي مِنَ الرَّضَاعَةِ يَسْتَأْذِنُ عَلَيَّ ، فَأَبَيْتُ أَنْ آذَنَ لَهُ حَتَّى أَسْتَأْمِرَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَلَمَّا جَاءَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قُلْتُ : إِنَّ عَمِّي مِنَ الرَّضَاعَةِ اسْتَأْذَنَ عَلَيَّ ، فَأَبَيْتُ أَنْ آذَنَ لَهُ ، فقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " فَلْيَلِجْ عَلَيْكِ عَمُّكِ " ، قُلْتُ : إِنَّمَا أَرْضَعَتْنِي الْمَرْأَةُ ، وَلَمْ يُرْضِعْنِي الرَّجُلُ ، قَالَ : " إِنَّهُ عَمُّكِ ، فَلْيَلِجْ عَلَيْكِ " ،
'A'isha (Allah be pleased with her) reported:My foster uncle came to me and sought permission (to enter the house), but I refused him permission until I had solicited the opinion of Allah's Messenger (ﷺ). When Allah's Messenger (ﷺ) came, I said to him: My foster-uncle sought my permission to (enter the house), but I did not permit him, whereupon Allah's Messenger (ﷺ) said: You better admit your uncle (into the house). I ('A'isha) said: It was the woman who suckled me and not the man. (But he) said: He is your uncle, admit him.

حدثنا أَبُو كُرَيْبٍ مُحَمَّدُ بْنُ الْعَلَاءِ ، حدثنا أَبُو أُسَامَةَ ، أَخْبَرَنا هِشَامٌ ، أَخْبَرَنِي أَبِي ، عَنْ زَيْنَبَ بِنْتِ أُمِّ سَلَمَةَ ، عَنْ أُمِّ حَبِيبَةَ بِنْتِ أَبِي سُفْيَانَ ، قَالَت : دَخَلَ عَلَيَّ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقُلْتُ لَهُ : هَلْ لَكَ فِي أُخْتِي بِنْتِ أَبِي سُفْيَانَ ، فقَالَ : " أَفْعَلُ مَاذَا " ، قُلْتُ : تَنْكِحُهَا ، قَالَ : " أَوَ تُحِبِّينَ ذَلِكِ " ، قُلْتُ : لَسْتُ لَكَ بِمُخْلِيَةٍ وَأَحَبُّ مَنْ شَرِكَنِي فِي الْخَيْرِ أُخْتِي ، قَالَ : " فَإِنَّهَا لَا تَحِلُّ لِي " ، قُلْتُ : فَإِنِّي أُخْبِرْتُ أَنَّكَ تَخْطُبُ دُرَّةَ بِنْتَ أَبِي سَلَمَةَ ، قَالَ : " بِنْتَ أُمِّ سَلَمَةَ " ، قُلْتُ : نَعَمْ ، قَالَ : " لَوْ أَنَّهَا لَمْ تَكُنْ رَبِيبَتِي فِي حِجْرِي ، مَا حَلَّتْ لِي ، إِنَّهَا ابْنَةُ أَخِي مِنَ الرَّضَاعَةِ ، أَرْضَعَتْنِي وَأَبَاهَا ثُوَيْبَةُ ، فَلَا تَعْرِضْنَ عَلَيَّ بَنَاتِكُنَّ ، وَلَا أَخَوَاتِكُنَّ " .
Umm Habiba, the daughter of AbuSufyan, reported: The Messenger of Allah (ﷺ) came to me and I said to him: Have you any inclination towards my sister, the daughter of Abu Sufyan (RA) ? He (the Holy Prophet) said: Then what should I do? I said: Marry her. He said: Do you like that? I said: I am not the exclusive (wife) of yours; I, therefore, wish to join my sister in good. He, said: She is not lawful for me. I said: I have been informed that you have given the proposal of marriage to Durrah daughter of Abu Salama. He said: You mean the daughter of Umm Salamah? I said: Yes. He said: Even if she had not been my step-daughter brought up under my guardianship, she would not have been lawful for me, for she is the daughter of my foster-brother (Hamza), for Thuwabia had suckled me and her father. So do not give me the proposal of the marriage of your daughters and sisters.

حدثنا زُهَيْرُ بْنُ حَرْبٍ ، حدثنا جَرِيرٌ ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ ، قَالَت : مَا رَأَيْتُ امْرَأَةً أَحَبَّ إِلَيَّ أَنْ أَكُونَ فِي مِسْلَاخِهَا مِنْ سَوْدَةَ بِنْتِ زَمْعَةَ مِنَ امْرَأَةٍ فِيهَا حِدَّةٌ ، قَالَت : " فَلَمَّا كَبِرَتْ جَعَلَتْ يَوْمَهَا مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِعَائِشَةَ ، قَالَت : يَا رَسُولَ اللَّهِ ، قَدْ جَعَلْتُ يَوْمِي مِنْكَ لِعَائِشَةَ ، فَكَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقْسِمُ لِعَائِشَةَ يَوْمَيْنِ ، يَوْمَهَا وَيَوْمَ سَوْدَةَ " ،
'A'isha (Allah be pleased with her) reported: Never did I find any woman more loving to me than Sauda bint Zam'a. I wished I could be exactly like her who was passionate. As she became old, she had made over her day (which she had to spend) with Allah's Messenger (ﷺ) to 'A'isha. She said: I have made over my day with you to 'A'isha. So Allah's Messenger (ﷺ) allotted two days to 'A'isha, her own day (when it was her turn) and that of Sauda.

A hadith like this has been transmitted on the authority of Hisham with the same chain of narrators (and the words are): When Sauda became old (the rest of the hadith is the same) and in the narration of Sharik there is an addition (of these words: "She was the first woman whom he (Allah's Apostle) (ﷺ) married after me."

حدثنا أَبُو كُرَيْبٍ مُحَمَّدُ بْنُ الْعَلَاءِ ، حدثنا أَبُو أُسَامَةَ ، عَنْ هِشَامٍ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ ، قَالَت : " كُنْتُ أَغَارُ عَلَى اللَّاتِي وَهَبْنَ أَنْفُسَهُنَّ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَأَقُولُ وَتَهَبُ الْمَرْأَةُ نَفْسَهَا فَلَمَّا أَنْزَلَ اللَّهُ عَزَّ وَجَلَّ : تُرْجِي مَنْ تَشَاءُ مِنْهُنَّ وَتُؤْوِي إِلَيْكَ مَنْ تَشَاءُ وَمَنِ ابْتَغَيْتَ مِمَّنْ عَزَلْتَ سورة الأحزاب آية 51 ، قَالَت : قُلْتُ : وَاللَّهِ مَا أَرَى رَبَّكَ إِلَّا يُسَارِعُ لَكَ فِي هَوَاكَ " .
'A'isha (Allah be pleased with her) reported: I felt jealous of the women who offered themselves to Allah's Messenger (ﷺ) and said: Then when Allah, the Exalted and Glorious, revealed this: "You may defer any one of them you wish, and take to yourself any you wish; and if you desire any you have set aside (no sin is chargeable to you)" (xxxiii. 51), I ('A'isha.) said: It seems to me that your Lord hastens to satisfy your desire.

وحدثناه أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، حدثنا عَبْدَةُ بْنُ سُلَيْمَانَ ، عَنْ هِشَامٍ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ ، أَنَّهَا كَانَتْ تَقُولُ : " أَمَا تَسْتَحْيِي امْرَأَةٌ تَهَبُ نَفْسَهَا لِرَجُلٍ حَتَّى أَنْزَلَ اللَّهُ عَزَّ وَجَلَّ : تُرْجِي مَنْ تَشَاءُ مِنْهُنَّ وَتُؤْوِي إِلَيْكَ مَنْ تَشَاءُ سورة الأحزاب آية 51 ، فَقُلْتُ : إِنَّ رَبَّكَ لَيُسَارِعُ لَكَ فِي هَوَاكَ " .
Hisham reported on the authority of his father that 'A'isha (Allah be pleased with her) used to say: Does the woman not feel shy of offering herself to a man? Then Allah the Exalted and Glorious revealed this verse: "You may defer any of them you wish and take to yourself any you wish." I ('A'isha said): It seems to me that your Lord hastens to satisfy your desire.

حدثنا أَبُو كُرَيْبٍ مُحَمَّدُ بْنُ الْعَلَاءِ ، وَهَارُونُ بْنُ عَبْدِ اللَّهِ ، قَالَا : حدثنا أَبُو أُسَامَةَ ، عَنْ هِشَامٍ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ ، قَالَت : كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يُحِبُّ الْحَلْوَاءَ وَالْعَسَلَ ، فَكَانَ إِذَا صَلَّى الْعَصْرَ دَارَ عَلَى نِسَائِهِ فَيَدْنُو مِنْهُنَّ ، فَدَخَلَ عَلَى حَفْصَةَ ، فَاحْتَبَسَ عَنْدَهَا أَكْثَرَ مِمَّا كَانَ يَحْتَبِسُ ، فَسَأَلْتُ عَنْ ذَلِكَ : فَقِيلَ لِي : أَهْدَتْ لَهَا امْرَأَةٌ مِنْ قَوْمِهَا عُكَّةً مِنْ عَسَلٍ ، فَسَقَتْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْهُ شَرْبَةً ، فَقُلْتُ : أَمَا وَاللَّهِ لَنَحْتَالَنَّ لَهُ فَذَكَرْتُ ذَلِكَ لِسَوْدَةَ ، وَقُلْتُ : إِذَا دَخَلَ عَلَيْكِ ، فَإِنَّهُ سَيَدْنُو مِنْكِ ، فَقُولِي لَهُ : يَا رَسُولَ اللَّهِ ، أَكَلْتَ مَغَافِيرَ ، فَإِنَّهُ سَيَقُولُ لَكِ : لَا ، فَقُولِي لَهُ : مَا هَذِهِ الرِّيح وكَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَشْتَدُّ عَلَيْهِ أَنْ يُوجَدَ مِنْهُ الرِّيحُ ، فَإِنَّهُ سَيَقُولُ لَكِ : سَقَتْنِي حَفْصَةُ شَرْبَةَ عَسَلٍ ، فَقُولِي لَهُ : جَرَسَتْ نَحْلُهُ الْعُرْفُطَ ، وَسَأَقُولُ ذَلِكِ لَهُ ، وَقُولِيهِ أَنْتِ يَا صَفِيَّةُ ، فَلَمَّا دَخَلَ عَلَى سَوْدَةَ ، قَالَت : تَقُولُ سَوْدَةُ : وَالَّذِي لَا إِلَهَ إِلَّا هُوَ لَقَدْ كِدْتُ أَنْ أُبَادِئَهُ بِالَّذِي قُلْتِ لِي ، وَإِنَّهُ لَعَلَى الْبَابِ ، فَرَقًا مِنْكِ ، فَلَمَّا دَنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَت : يَا رَسُولَ اللَّهِ ، أَكَلْتَ مَغَافِيرَ ؟ قَالَ : " لَا " ، قَالَت : فَمَا هَذِهِ الرِّيح ؟ قَالَ : " سَقَتْنِي حَفْصَةُ شَرْبَةَ عَسَلٍ " ، قَالَت : جَرَسَتْ نَحْلُهُ الْعُرْفُطَ ، فَلَمَّا دَخَلَ عَلَيَّ قُلْتُ لَهُ مِثْلَ ذَلِكَ ، ثُمَّ دَخَلَ عَلَى صَفِيَّةَ ، فقَالَت بِمِثْلِ ذَلِكَ ، فَلَمَّا دَخَلَ عَلَى حَفْصَةَ ، قَالَت : يَا رَسُولَ اللَّهِ ، أَلَا أَسْقِيكَ مِنْهُ ، قَالَ : لَا حَاجَةَ لِي بِهِ ، قَالَت : تَقُولُ سَوْدَةُ : سُبْحَانَ اللَّهِ ، وَاللَّهِ لَقَدْ حَرَمْنَاهُ ، قَالَت : قُلْتُ لَهَا : اسْكُتِي ، قَالَ أَبُو إِسْحَاقَ إِبْرَاهِيمُ : حدثنا الْحَسَنُ بْنُ بِشْرِ بْنِ الْقَاسِمِ ، حدثنا أَبُو أُسَامَةَ ، بِهَذَا سَوَاءً ،
'A'isha (Allah be pleased with her) reported Allah's Messenger (ﷺ) liked sweet (dish) and honey. After saying the afternoon prayer he used to visit his wives going close to them. So he went to Hafsa and stayed with her more than what was his usual stay. I ('A'isha) asked about that. It was said to me: A woman of her family had sent her a small vessel of honey as a gift, and she gave to Allah's Messenger (ﷺ) from that a drink. I said: By Allah, we would also contrive a device for him. I mentioned that to Sauda, and said: When he (Allah's Apostle) (ﷺ) would visit you and draw close to you, say to him: Allah's Messenger, have you taken maghafir? And he would'say to you: No. Then say to him: What is this odour? And Allah's Messenger (ﷺ) felt it very much that unpleasant odour should emit from him. So he would say to you: Hafsa has given me a drink of honey. Then you should say to him: The honey-bees might have sucked 'Urfut, and I would also say the same to him and. Safiyya, you should also say this. So when he (the Holy Prophet) came to Sauda, she said: By Him besides whom there is no god, it was under compulsion that I had decided to state that which you told me when he would be at a little distance at the door. So when Allah's Messenger (ﷺ) came near, she said: Messenger of Allah, did you eat Maghafir? He said: No. She (again) said: Then what is this odour? He said: Hafsa gave me honey to drink. She said: The honey-bee might have sucked 'Urfut. When he came to me I told him like this. He then visited Safiyya and she also said to him like this. When he (again) visited Hafsa, she said: Messenger of Allah, should I not give you that (drink)? He said: I do not need that. Sauda said: Hallowed be Allah, by Him we have (contrived) to make that (honey) unlawful for him. I said to her: Keep quiet.

وحدثنا وحدثنا أَبُو كُرَيْبٍ ، حدثنا أَبُو أُسَامَةَ ، عَنْ هِشَامٍ ، حَدَّثَنِي أَبِي ، قَالَ : تَزَوَّجَ يَحْيَى بْنُ سَعِيدِ بْنِ الْعَاصِ بِنْتَ عَبْدِ الرَّحْمَنِ بْنِ الْحَكَمِ ، فَطَلَّقَهَا فَأَخْرَجَهَا مِنْ عَنْدِهِ ، فَعَابَ ذَلِكَ عَلَيْهِمْ عُرْوَةُ ، فقَالُوا : إِنَّ فَاطِمَةَ قَدْ خَرَجَتْ ، قَالَ عُرْوَةُ : فَأَتَيْتُ عَائِشَةَ ، فَأَخْبَرْتُهَا بِذَلِكَ ، فقَالَت : " مَا لِفَاطِمَةَ بِنْتِ قَيْسٍ خَيْرٌ فِي أَنْ تَذْكُرَ هَذَا الْحَدِيثَ " .
Hisham reported on the authority of his father that Yahya bin Sa'id bin al-'As married the daughter of 'Abdul Rahman bin al-Hakam, and he divorced her and he turned her out from his house. 'Urwa (RA) criticised this (action) of theirs (the members of the family of her in-laws). They said: Verily, Fatima too went out (of her in-laws' house). 'Urwa said: I came to 'A'isha (Allah be pleased with her) and told her about it and she said: There is no good for Fatima bint Qais (Allah be pleased with her) in making mention of it.

وَحدثنا مُحَمَّدُ بْنُ الْمُثَنَّى ، حدثنا حَفْصُ بْنُ غِيَاثٍ ، حدثنا هِشَامٌ ، عَنْ أَبِيهِ ، عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ ، قَالَت : قُلْتُ : يَا رَسُولَ اللَّهِ ، زَوْجِي طَلَّقَنِي ثَلَاثًا ، وَأَخَافُ أَنْ يُقْتَحَمَ عَلَيَّ ، قَالَ : " فَأَمَرَهَا فَتَحَوَّلَتْ " .
Fatima bint Qais (Allah be pleased with her) reported that she said: Allah's Messenger, my husband has divorced me with three pronouncements and I am afraid that I may be put to hardship, and so he commanded her and so she moved (to another house).

وحَدَّثَنَا أَبُو كُرَيْبٍ مُحَمَّدُ بْنُ الْعَلَاءِ الْهَمْدَانِيُّ ، حَدَّثَنَا أَبُو أُسَامَةَ ، حَدَّثَنَا هِشَامُ بْنُ عُرْوَةَ ، أَخْبَرَنِي أَبِي ، عَنْ عَائِشَةَ ، قَالَتْ : دَخَلَتْ عَلَيَّ بَرِيرَةُ ، فَقَالَتْ : إِنَّ أَهْلِي كَاتَبُونِي عَلَى تِسْعِ أَوَاقٍ ، فِي تِسْعِ سِنِينَ فِي كُلِّ سَنَةٍ أُوقِيَّةٌ ، فَأَعِينِينِي ، فَقُلْتُ لَهَا : إِنْ شَاءَ أَهْلُكِ أَنْ أَعُدَّهَا لَهُمْ عَدَّةً وَاحِدَةً ، وَأُعْتِقَكِ وَيَكُونَ الْوَلَاءُ لِي ، فَعَلْتُ فَذَكَرَتْ ذَلِكَ لِأَهْلِهَا ، فَأَبَوْا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لَهُمْ ، فَأَتَتْنِي فَذَكَرَتْ ذَلِكَ ، قَالَتْ : فَانْتَهَرْتُهَا ، فَقَالَتْ : لَا هَا اللَّهِ إِذَا قَالَتْ ، فَسَمِعَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَسَأَلَنِي ، فَأَخْبَرْتُهُ ، فَقَالَ : " اشْتَرِيهَا وَأَعْتِقِيهَا ، وَاشْتَرِطِي لَهُمُ الْوَلَاءَ ، فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ " ، فَفَعَلْتُ ، قَالَتْ : ثُمَّ خَطَبَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَشِيَّةً ، فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ بِمَا هُوَ أَهْلُهُ ، ثُمَّ قَالَ : " أَمَّا بَعْدُ فَمَا بَالُ أَقْوَامٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ ، مَا كَانَ مِنْ شَرْطٍ لَيْسَ فِي كِتَابِ اللَّهِ عَزَّ وَجَلَّ ، فَهُوَ بَاطِلٌ ، وَإِنْ كَانَ مِائَةَ شَرْطٍ كِتَابُ اللَّهِ أَحَقُّ وَشَرْطُ اللَّهِ أَوْثَقُ ، مَا بَالُ رِجَالٍ مِنْكُمْ يَقُولُ أَحَدُهُمْ أَعْتِقْ فُلَانًا وَالْوَلَاءُ لِي إِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ "
'A'isha (Allah be pleased with her) reported: Barira came to me and said: My family (owners) have made contract with me (for granting freedom) for nine 'uqiyas (of silver) payable in nine years, one 'uqiya every year. Help me (in making this payment). I said to her: If your family so desires, I am prepared to make them the full payment in one instalment, and thus secure freedom for you, but the right of inheritance will vest in me, if I do so. She (Barira) made a mention of that to her family, but they refused (except) on the condition that the right of inheritance would vest in them. She came to me and made mention of if. She ('A'isha) said: I scolded her. She (Barira) said: By Allah, it is not possible (they will never agree to it). And as she was saying it, Allah's Messenger (ﷺ) heard, and he asked me, I informed him and he said: Buy her and emancipate her, and let the right of inheritance vest in them, for they cannot claim it (rightfully) since the right of inherritance vests with one who emancipates (the slave; therefore, these people have no right to lay such false claims). And I did so. She ('A'isha) said: Then Allah's Messenger (ﷺ) delivered a sermon in the evening. He extolled Allah and praised Him with what He deserves, and then said afterwards,: What has happened to the people that they lay down conditions which are not found in the Book of Allah? And the condition which is not found in the Book of Allah is invalid, even if its number is one hundred. The Book of Allah is more true (than any other deed) and the condition laid down by Allah is more binding (than any other condition). What has happened to the people among you that someone among you says: "Emancipate so and so, but the right of inheritance vests in me"? Verily, the right of inheritance vests in one who emancipates.

وحَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، وَأَبُو كُرَيْبٍ ، قَالَا : حَدَّثَنَا ابْنُ نُمَيْرٍ . ح وحَدَّثَنَا أَبُو كُرَيْبٍ ، حَدَّثَنَا وَكِيعٌ . ح وحَدَّثَنَا زُهَيْرُ بْنُ حَرْبٍ ، وَإِسْحَاقُ بْنُ إِبْرَاهِيمَ جميعا عَنْ جَرِيرٍ ، كُلُّهُمْ عَنْ هِشَامِ بْنِ عُرْوَةَ ، بِهَذَا الْإِسْنَادِ نَحْوَ حَدِيثِ أَبِي أُسَامَةَ ، غَيْرَ أَنَّ فِي حَدِيثِ جَرِيرٍ ، قَالَ : وَكَانَ زَوْجُهَا عَبْدًا ، فَخَيَّرَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَاخْتَارَتْ نَفْسَهَا ، وَلَوْ كَانَ حُرًّا لَمْ يُخَيِّرْهَا وَلَيْسَ فِي حَدِيثِهِمْ أَمَّا بَعْدُ .
Hisham bin 'Urwa narrated a hadith like this with the same chain of trans mitters except (with this change) that in the hadith transmitted on the authority of jarir (the words are): Her (Barira's) husband was a slave, so Allah's Messenger (ﷺ) gave her the option (either to retain her matrimonial relation with her husband or sever it off). She opted to break off (and secure freedom for her even from the matrimonial alliance). And if he were free he would not have given her the option. In the hadith narrated on the authority (of this chain of transmitters) these words are not found: Amma ba'du.

حَدَّثَنَا زُهَيْرُ بْنُ حَرْبٍ ، وَمُحَمَّدُ بْنُ الْعَلَاءِ ، وَاللَّفْظُ لِزُهَيْرٍ ، قَالَا : حَدَّثَنَا أَبُو مُعَاوِيَةَ ، حَدَّثَنَا هِشَامُ بْنُ عُرْوَةَ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ ، قَالَتْ : كَانَ فِي بَرِيرَةَ ثَلَاثُ قَضِيَّاتٍ أَرَادَ أَهْلُهَا أَنْ يَبِيعُوهَا وَيَشْتَرِطُوا وَلَاءَهَا ، فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ : " اشْتَرِيهَا وَأَعْتِقِيهَا ، فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ " ، قَالَتْ : وَعَتَقَتْ ، فَخَيَّرَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَاخْتَارَتْ نَفْسَهَا ، قَالَتْ : وَكَانَ النَّاسُ يَتَصَدَّقُونَ عَلَيْهَا وَتُهْدِي لَنَا ، فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " هُوَ عَلَيْهَا صَدَقَةٌ ، وَهُوَ لَكُمْ هَدِيَّةٌ فَكُلُوهُ " .
'Abdul Rahman bin al. Qasim reported on the authority of his father: 'A'isha (Allah be pleased with her) said: There were three issues which were clarified in case of Barira: her owners had decided to sell her on the condition that the right of her inheritance would vest with them. She ('A'isha) said: I made a mention of that to Allah's Apostle (ﷺ) and he said: Buy her and emancipate her, for verily the right of inheritance vests with one who emancipates. She said that she emancipated (her) and Allah's Messenger (ﷺ) gave her the option (either to retain her matrimonial alliance or break it after emancipation). She (taking advantage of the option) opted for herself (the severing of matrimonial alliance). 'A'isha said: The people used to give her charity and she gave us that as gift. I made a mention of it to Allah's Apostle (ﷺ) , whereupon he said: That is charity for her but gift for you, so take that.

حَدَّثَنَا أَبُو الرَّبِيعِ الْعَتَكِيُّ ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ أَبِيهِ : " أَنَّ أَرْوَى بِنْتَ أُوَيْسٍ ادَّعَتْ عَلَى سَعِيدِ بْنِ زَيْدٍ أَنَّهُ أَخَذَ شَيْئًا مِنْ أَرْضِهَا ، فَخَاصَمَتْهُ إِلَى مَرْوَانَ بْنِ الْحَكَمِ فَقَالَ سَعِيدٌ : أَنَا كُنْتُ آخُذُ مِنْ أَرْضِهَا شَيْئًا بَعْدَ الَّذِي سَمِعْتُ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : وَمَا سَمِعْتَ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : مَنْ أَخَذَ شِبْرًا مِنَ الْأَرْضِ ظُلْمًا ، طُوِّقَهُ إِلَى سَبْعِ أَرَضِينَ ، فَقَالَ لَهُ مَرْوَانُ : لَا أَسْأَلُكَ بَيِّنَةً بَعْدَ هَذَا ، فَقَالَ : اللَّهُمَّ إِنْ كَانَتْ كَاذِبَةً فَعَمِّ بَصَرَهَا وَاقْتُلْهَا فِي أَرْضِهَا ، قَالَ : فَمَا مَاتَتْ حَتَّى ذَهَبَ بَصَرُهَا ، ثُمَّ بَيْنَا هِيَ تَمْشِي فِي أَرْضِهَا إِذْ وَقَعَتْ فِي حُفْرَةٍ فَمَاتَتْ " .
Hisham bin Urwa reported on the authority of his father (RA) that Arwa bint Uwais disputed with Sa'id bin Zaid that he had seized some of the land belonging to her. She brought this dispute before Marwan bin al-Hakam. Sa'id said: How could I take a part of her land, after what I heard from Allah's Messenger (may peace be upon'him)? He (Marwan) said: What did you hear from Allah's Messenger (ﷺ) ? He said: I heard Allah's Messenger (ﷺ) say: He who wrongly took a span of land would be made to wear around his neck seven earths. Marwan said: I do not ask any evidence from you after this. He (Sa'id) said: O Allah, make her blind if she has told a lie and kill her in her own land. He (the narrator) said: She did not die until she had lost her eyesight, and (one day) as she was walking in her land, she fell down into a pit and died.

Sa'id bin Zaid reported: I heard Allah's Apostle (ﷺ) say: He who took a span of earth wrongly would be made to wear around his neck seven earths on the Day of Resurrection.

حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ ، حَدَّثَنَا جَرِيرٌ ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ أَبِيهِ ، قَالَ : حَدَّثَنَا النُّعْمَانُ بْنُ بَشِيرٍ ، قَالَ : " وَقَدْ أَعْطَاهُ أَبُوهُ غُلَامًا ، فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : مَا هَذَا الْغُلَامُ ؟ قَالَ : أَعْطَانِيهِ أَبِي ، قَالَ : فَكُلَّ إِخْوَتِهِ أَعْطَيْتَهُ كَمَا أَعْطَيْتَ هَذَا ، قَالَ : لَا ، قَالَ : فَرُدَّهُ " .
Nu'man bin Bashir reported that his father had donated a slave to him. Allah's Apostle (ﷺ) (may peace he upon him) said: Who is this slave (how have you come to possess it)? Thereupon he (Nu'man bin Bashir) said: My father has donated it to me, whereupon he said: Have all brothers (of yours) been given this gift as given to you? He said: No. Then he (the Holy Prophet) said: Then return him.

حَدَّثَنِي إِبْرَاهِيمُ بْنُ مُوسَى الرَّازِيُّ ، أَخْبَرَنَا عِيسَى يَعْنِي ابْنَ يُونُسَ . ح وحَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، وَأَبُو كُرَيْبٍ ، قَالَا : حَدَّثَنَا وَكِيعٌ . ح وحَدَّثَنَا أَبُو كُرَيْبٍ ، حَدَّثَنَا ابْنُ نُمَيْرٍ كُلُّهُمْ ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ أَبِيهِ ، عَنْ ابْنِ عَبَّاسٍ ، قَالَ : " لَوْ أَنَّ النَّاسَ غَضُّوا مِنَ الثُّلُثِ إِلَى الرُّبُعِ ، فَإِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : الثُّلُثُ وَالثُّلُثُ كَثِيرٌ " وَفِي حَدِيثِ وَكِيعٍ كَبِيرٌ أَوْ كَثِيرٌ .
Ibn 'Abbas (RA) said: (I wish) if people would reduce from third to fourth (part for making a will of their property), for Allah's Messenger (ﷺ) said: So far as the third (part) is concerned it is quite substantial. In the hadith transmitted on the authority of Waki (the words are) "large" or "much".

A'isha (Allah be pleased with her) reported that a man said to Allah's Apostle (ﷺ) : My mother died all of a sudden, and I think if she (could have the opportunity) to speak she would have (made a will) regarding Sadaqa'. Will I be entitled to reward if I give charity on her behalf? He (the Holy Prophet) said: Yes.

A'isha (Allah be pleased with her) reported that a man came to Allah's Apostle (ﷺ) and said: Allah's Messenger, my mother died all of a sudden without making any will. I think if (she could have the opportunity) to speak she would have made a Sadaqa. Would there be any reward for her if I give charity on her behalf? He (the Holy Prophet) said: Yes.

وحَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، وَأَبُو كُرَيْبٍ ، وَإِسْحَاقُ بْنُ إِبْرَاهِيمَ وَاللَّفْظُ لِأَبِي بَكْرٍ ، قَالَ إِسْحَاقُ أَخْبَرَنَا ، وَقَالَ الآخران حَدَّثَنَا وَكِيعٌ ، عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ ، عَنْ الْمِسْوَرِ بْنِ مَخْرَمَةَ ، قَالَ : اسْتَشَارَ عُمَرُ بْنُ الْخَطَّابِ النَّاسَ فِي إِمْلَاصِ الْمَرْأَةِ ، فَقَال الْمُغِيرَةُ بْنُ شُعْبَةَ ، : " شَهِدْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى فِيهِ بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ " ، قَالَ : فَقَالَ : عُمَرُ ائْتِنِي بِمَنْ يَشْهَدُ مَعَكَ ، قَالَ : فَشَهِدَ لَهُ مُحَمَّدُ بْنُ مَسْلمَةَ .
Miswar bin Makhrama reported that 'Umar bin Khattab consulted people about the diyat of abortion of an unboam child. Mughira bin Shu'bahh said: I bear witness to the fact that Allah's Messenger (ﷺ) gave judgment about it that a good quality of slave or female slave should be given for it. Thereupon 'Umar said: Bring one who may bear witness to you. Then Muhammad bin Maslama bore witness to him.

'A'isha reported that during the lifetime of Allah's Messenger (ﷺ) the hand of the thief was not cut off for less than the price of a shield, iron coat or armour and both of them are valuable.

حَدَّثَنَا يَحْيَي بْنُ يَحْيَي التَّمِيمِيُّ ، أَخْبَرَنَا أَبُو مُعَاوِيَةَ ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ أَبِيهِ ، عَنْ زَيْنَبَ بِنْتِ أَبِي سَلَمَة َ ، عَنْ أُمِّ سَلَمَةَ ، قَالَتْ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِنَّكُمْ تَخْتَصِمُونَ إِلَيَّ وَلَعَلَّ بَعْضَكُمْ أَنْ يَكُونَ أَلْحَنَ بِحُجَّتِهِ مِنْ بَعْضٍ ، فَأَقْضِيَ لَهُ عَلَى نَحْوٍ مِمَّا أَسْمَعُ مِنْهُ ، فَمَنْ قَطَعْتُ لَهُ مِنْ حَقِّ أَخِيهِ شَيْئًا ، فَلَا يَأْخُذْهُ فَإِنَّمَا أَقْطَعُ لَهُ بِهِ قِطْعَةً مِنَ النَّارِ " ،
Umm Salamah reported Allah's Messenger (ﷺ) as saying: You bring to me, for (judgment) your disputes, some of you perhaps being more eloquent in their plea than others, so I give judgment on their behalf according to what I hear from them. (Bear in mind, in my judgment) if I slice off anything for him from the right of his brother, he should not accept that, for I sliced off for him a portion from the Hell.

حَدَّثَنِي عَلِيُّ بْنُ حُجْرٍ السَّعْدِيُّ ، حَدَّثَنَا عَلِيُّ بْنُ مُسْهِرٍ ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ ، قَالَتْ : " دَخَلَتْ هِنْدٌ بِنْتُ عُتْبَةَ امْرَأَةُ أَبِي سُفْيَانَ عَلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَتْ : يَا رَسُولَ اللَّهِ ، إِنَّ أَبَا سُفْيَانَ رَجُلٌ شَحِيحٌ ، لَا يُعْطِينِي مِنَ النَّفَقَةِ مَا يَكْفِينِي وَيَكْفِي بَنِيَّ ، إِلَّا مَا أَخَذْتُ مِنْ مَالِهِ بِغَيْرِ عِلْمِهِ ، فَهَلْ عَلَيَّ فِي ذَلِكَ مِنْ جُنَاحٍ ؟ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " خُذِي مِنْ مَالِهِ بِالْمَعْرُوفِ مَا يَكْفِيكِ وَيَكْفِي بَنِيكِ " ،
A'isha reported: Hind, the daughter of 'Utba, wife of Abu Sufyan (RA) , came to Allah's Messenger (ﷺ) and said: Abu Sufyan (RA) is a miserly person. He does not give adequate maintenance for me and my children, but (I am constrained) to take from his wealth (some part of it) without his knowledge. Is there any sin for me? Thereupon Allah's Messenger (ﷺ) said: Take from his property what is customary which may suffice you and your children.

وحَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، وَمُحَمَّدُ بْنُ الْعَلَاءِ الْهَمْدَانِيُّ كِلَاهُمَا ، عَنْ ابْنِ نُمَيْرٍ ، قَالَ ابْنُ الْعَلَاءِ : حَدَّثَنَا ابْنُ نُمَيْرٍ ، حَدَّثَنَا هِشَامٌ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ ، قَالَتْ : " أُصِيبَ سَعْدٌ يَوْمَ الْخَنْدَقِ رَمَاهُ رَجُلٌ مِنْ قُرَيْشٍ يُقَالُ لَهُ ابْنُ الْعَرِقَةِ رَمَاهُ فِي الْأَكْحَلِ ، فَضَرَبَ عَلَيْهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَيْمَةً فِي الْمَسْجِدِ يَعُودُهُ مِنْ قَرِيبٍ ، فَلَمَّا رَجَعَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ الْخَنْدَقِ ، وَضَعَ السِّلَاحَ فَاغْتَسَلَ فَأَتَاهُ جِبْرِيلُ وَهُوَ يَنْفُضُ رَأْسَهُ مِنَ الْغُبَارِ ، فَقَالَ : وَضَعْتَ السِّلَاحَ وَاللَّهِ مَا وَضَعْنَاهُ اخْرُجْ إِلَيْهِمْ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : فَأَيْنَ ؟ ، فَأَشَارَ إِلَى بَنِي قُرَيْظَةَ فَقَاتَلَهُمْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَنَزَلُوا عَلَى حُكْمِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَرَدَّ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْحُكْمَ فِيهِمْ إِلَى سَعْدٍ ، قَالَ : فَإِنِّي أَحْكُمُ فِيهِمْ أَنْ تُقْتَلَ الْمُقَاتِلَةُ ، وَأَنْ تُسْبَى الذُّرِّيَّةُ وَالنِّسَاءُ وَتُقْسَمَ أَمْوَالُهُمْ " ،
It has been narrated on the authority of A'isha who said: Sa'd was wounded on the day of the Battle of the Ditch. A man from the Quraish called Ibn al-Ariqah shot at him an arrow which pierced the artery in the middle of his forearm. The Messenger of Allah (ﷺ) pitched a tent for him in the mosque and would inquire after him being in close proximity. When he returned from the Ditch and laid down his arms and took a bath, the angel Gabriel (ؑ) appeared to him and he was removing dust from his hair (as if he had just returned from the battle). The latter said: You have laid down arms. By God, we haven't (yet) laid them down. So march against them. The Messenger of Allah (ﷺ) asked: Where? He pointad to Banu Quraiza. So the Messenger of Allah (ﷺ) (may peace he upon him) fought against them. They surrendered at the command of the Messenger of Allah (ﷺ) , but he referred the decision about them to Sa'd who said: I decide about them that those of them who can fight be killed, their women and children taken prisoners and their properties distributed (among the Muslims).

وحَدَّثَنَا أَبُو كُرَيْبٍ ، حَدَّثَنَا ابْنُ نُمَيْرٍ ، حَدَّثَنَا هِشَامٌ ، قَالَ : قَالَ أَبِي : فَأُخْبِرْتُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " لَقَدْ حَكَمْتَ فِيهِمْ بِحُكْمِ اللَّهِ عَزَّ وَجَلَّ " .
It has been narrated on the authority of Hisham (who learnt it from his father) that the Messenger of Allah (ﷺ) said (to Sa'd): You have adjudged their case with the judgment of God the Exalted and Glorified.

حَدَّثَنَا أَبُو كُرَيْبٍ ، حَدَّثَنَا ابْنُ نُمَيْرٍ ، عَنْ هِشَامٍ ، أَخْبَرَنِي أَبِي ، عَنْ عَائِشَةَ " أَنَّ سَعْدًا قَالَ : وَتَحَجَّرَ كَلْمُهُ لِلْبُرْءِ ، فَقَالَ : اللَّهُمَّ إِنَّكَ تَعْلَمُ أَنْ لَيْسَ أَحَدٌ أَحَبَّ إِلَيَّ أَنْ أُجَاهِدَ فِيكَ مِنْ قَوْمٍ كَذَّبُوا رَسُولَكَ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَأَخْرَجُوهُ ، اللَّهُمَّ فَإِنْ كَانَ بَقِيَ مِنْ حَرْبِ قُرَيْشٍ شَيْءٌ فَأَبْقِنِي أُجَاهِدْهُمْ فِيكَ ، اللَّهُمَّ فَإِنِّي أَظُنُّ أَنَّكَ قَدْ وَضَعْتَ الْحَرْبَ بَيْنَنَا وَبَيْنَهُمْ فَإِنْ كُنْتَ وَضَعْتَ الْحَرْبَ بَيْنَنَا وَبَيْنَهُمْ فَافْجُرْهَا ، وَاجْعَلْ مَوْتِي فِيهَا ، فَانْفَجَرَتْ مِنْ لَبَّتِهِ ، فَلَمْ يَرُعْهُمْ وَفِي الْمَسْجِدِ مَعَهُ خَيْمَةٌ مِنْ بَنِي غِفَارٍ إِلَّا وَالدَّمُ يَسِيلُ إِلَيْهِمْ ، فَقَالُوا : يَا أَهْلَ الْخَيْمَةِ مَا هَذَا الَّذِي يَأْتِينَا مِنْ قِبَلِكُمْ ؟ ، فَإِذَا سَعْدٌ جُرْحُهُ يَغِذُّ دَمًا فَمَاتَ مِنْهَا " ،
It has been narrated on the authority of 'A'isha that Sa'd's wound became dry and was going to heal when he prayed: O God, surely Thou knowest that nothing is dearer to me than that I should fight for Thy cause against the people who disbelieved Your Messenger (ﷺ) and turned him out (from his native place). If anything yet remains to be decided from the war against the Quraish, spare my life so that I may fight against them in Thy cause. O Lord, I think Thou hast ended the war between us and them. If Thou hast done so, open my wound (so that it may discharge) and cause my death thereby. So the wound began to bleed from the front part of his neck. The people were not scared except when the blood flowed towards them, and in the mosque along with Sa'd's tent was the tent of Banu Ghifar. They said: O people of the tent, what is it that is coming to us from you? Lo! it was Sa'd's wound that was bleeding and he died thereof.

وحَدَّثَنَا عَلِيُّ بْنُ الْحُسَيْنِ بْنِ سُلَيْمَانَ الْكُوفِيُّ ، حَدَّثَنَا عَبْدَةُ ، عَنْ هِشَامٍ بِهَذَا الْإِسْنَادِ نَحْوَهُ غَيْرَ أَنَّهُ ، قَالَ : فَانْفَجَرَ مِنْ لَيْلَتِهِ فَمَا زَالَ يَسِيلُ حَتَّى مَاتَ ، وَزَادَ فِي الْحَدِيثِ قَالَ : فَذَاكَ حِينَ يَقُولُ الشَّاعِرُ : أَلَا يَا سَعْدُ سَعْدَ بَنِي مُعَاذٍ فَمَا فَعَلَتْ قُرَيْظَةُ ، وَالنَّضِيرُ لَعَمْرُكَ إِنَّ سَعْدَ بَنِي مُعَاذٍ غَدَاةَ تَحَمَّلُوا لَهُوَ الصَّبُورُ تَرَكْتُمْ قِدْرَكُمْ لَا شَيْءَ فِيهَا وَقِدْرُ الْقَوْمِ حَامِيَةٌ تَفُورُ ، وَقَدْ قَالَ الْكَرِيمُ أَبُو حُبَابٍ : أَقِيمُوا قَيْنُقَاعُ وَلَا تَسِيرُوا وَقَدْ كَانُوا بِبَلْدَتِهِمْ ثِقَالًا كَمَا ثَقُلَتْ بِمَيْطَانَ الصُّخُورُ .
This tradition has been narrated by Hisham through the same chain of transmitters with a little difference in the wording. He said: (His wound) began to bleed that very night and it continued to bleed until he died. He has made the addition that it was then that (a non-believing) poet said: Hark, O Sa'd, Sa'd of Banu Mu'adh, What have the Quraiaa and Nadir done? By thy life! Sa'd bin Mu'adh>br> Was steadfast on the morn they departed. You have left your cooking-pot empty, While the cooking-pot of the people is hot and boiling. Abu Hubab the nobleman has said, O Qainuqa', do not depart. They were weighty in their country just aa rocks are weighty in Maitan.

حَدَّثَنَا أَبُو كُرَيْبٍ مُحَمَّدُ بْنُ الْعَلَاءِ ، حَدَّثَنَا أَبُو أُسَامَةَ ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ أَبِيهِ ، عَنْ ابْنِ عُمَرَ ، قَالَ : " حَضَرْتُ أَبِي حِينَ أُصِيبَ ، فَأَثْنَوْا عَلَيْهِ ، وَقَالُوا : جَزَاكَ اللَّهُ خَيْرًا ، فَقَالَ : رَاغِبٌ وَرَاهِبٌ ، قَالُوا : اسْتَخْلِفْ ، فَقَالَ : أَتَحَمَّلُ أَمْرَكُمْ حَيًّا وَمَيِّتًا ، لَوَدِدْتُ أَنَّ حَظِّي مِنْهَا الْكَفَافُ لَا عَلَيَّ ، وَلَا لِي فَإِنْ أَسْتَخْلِفْ ، فَقَدِ اسْتَخْلَفَ مَنْ هُوَ خَيْرٌ مِنِّي يَعْنِي أَبَا بَكْرٍ ، وَإِنْ أَتْرُكْكُمْ ، فَقَدْ تَرَكَكُمْ مَنْ هُوَ خَيْرٌ مِنِّي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : عَبْدُ اللَّهِ فَعَرَفْتُ أَنَّهُ حِينَ ذَكَرَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ غَيْرُ مُسْتَخْلِفٍ " .
It has been narrated on the authority of 'Abdullah bin 'Umar who said: I was present with my father when he was wounded. People praised him and said: May God give you a noble recompense! He said: I am hopeful (of God's mercy) as well as afraid (of His wrath) People said: Appoint anyone as your successor. He said: Should I carry the burden of conducting your affairs in my life as well as in my death? (So far as Caliphate is concerned) I wish I could acquit myself (before the Almighty) in a way that there is neither anything to my credit nor anything to my discredit. If I would appoint my successor, (I would because) one better than me did so. (He meant Abu Bakr.) If I would leave You alone, (I would do so because) one better than me, i. e. the Messenger of Allah (ﷺ) , did so. 'Abdullah says: When he mentioned the Messenger of Allah (ﷺ) I understood that he would not appoint anyone as Caliph.

حَدَّثَنَا أَبُو كُرَيْبٍ مُحَمَّدُ بْنُ الْعَلَاءِ ، حَدَّثَنَا أَبُو أُسَامَةَ ، حَدَّثَنَا هِشَامٌ ، عَنْ أَبِيهِ ، عَنْ أَبِي حُمَيْدٍ السَّاعِدِيِّ ، قَالَ : " اسْتَعْمَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ رَجُلًا مِنَ الْأَزْدِ عَلَى صَدَقَاتِ بَنِي سُلَيْمٍ يُدْعَى ابْنَ الْأُتْبِيَّةِ ، فَلَمَّا جَاءَ حَاسَبَهُ ، قَالَ : هَذَا مَالُكُمْ وَهَذَا هَدِيَّةٌ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : فَهَلَّا جَلَسْتَ فِي بَيْتِ أَبِيكَ وَأُمِّكَ حَتَّى تَأْتِيَكَ هَدِيَّتُكَ إِنْ كُنْتَ صَادِقًا ، ثُمَّ خَطَبَنَا فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ ، ثُمَّ قَالَ : أَمَّا بَعْدُ فَإِنِّي أَسْتَعْمِلُ الرَّجُلَ مِنْكُمْ عَلَى الْعَمَلِ مِمَّا وَلَّانِي اللَّهُ ، فَيَأْتِي ، فَيَقُولُ : هَذَا مَالُكُمْ وَهَذَا هَدِيَّةٌ أُهْدِيَتْ لِي ، أَفَلَا جَلَسَ فِي بَيْتِ أَبِيهِ وَأُمِّهِ حَتَّى تَأْتِيَهُ هَدِيَّتُهُ إِنْ كَانَ صَادِقًا ، وَاللَّهِ لَا يَأْخُذُ أَحَدٌ مِنْكُمْ مِنْهَا شَيْئًا بِغَيْرِ حَقِّهِ إِلَّا لَقِيَ اللَّهَ تَعَالَى يَحْمِلُهُ يَوْمَ الْقِيَامَةِ ، فَلَأَعْرِفَنَّ أَحَدًا مِنْكُمْ لَقِيَ اللَّهَ يَحْمِلُ بَعِيرًا لَهُ رُغَاءٌ أَوْ بَقَرَةً لَهَا خُوَارٌ أَوْ شَاةً تَيْعَرُ ، ثُمَّ رَفَعَ يَدَيْهِ حَتَّى رُئِيَ بَيَاضُ إِبْطَيْهِ ، ثُمَّ قَالَ : اللَّهُمَّ هَلْ بَلَّغْتُ بَصُرَ عَيْنِي وَسَمِعَ أُذُنِي " ،
It has been reported on the authority of Abu Humaid as-Sa'idi who said: The Holy Prophet (ﷺ) appointed Ibn Lutbiyya, a man from the Azd tribe, in charge of Sadaqa (authorising him to receive gifts from the people on behalf of the State). He came with the collectio, gave it to the Holy Prophet (ﷺ) . and said: This wealth is for you and this is a gift presented to me. The Holy Prophet (ﷺ) said to him: Why didn't you remain in the house of your father and your mother to see whether gifts were presented to you or not. Then he stood up to deliver a sermon. Here follows the tradition like the tradition of Sufyan.

وحَدَّثَنَا أَبُو كُرَيْبٍ ، حَدَّثَنَا عَبْدَةُ ، وَابْنُ نُمَيْرٍ ، وأبو معاوية . ح وحَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، حَدَّثَنَا عَبْدُ الرَّحِيمِ بْنُ سُلَيْمَانَ . ح وحَدَّثَنَا ابْنُ أَبِي عُمَرَ ، حَدَّثَنَا سُفْيَانُ كُلُّهُمْ ، عَنْ هِشَامٍ بِهَذَا الْإِسْنَادِ ، وَفِي حَدِيثِ عَبْدَةَ ، وَابْنِ نُمَيْرٍ ، فَلَمَّا جَاءَ حَاسَبَهُ كَمَا ، قَالَ أَبُو أُسَامَةَ وَفِي حَدِيثِ ابْنِ نُمَيْرٍ تَعْلَمُنَّ وَاللَّهِ ، وَالَّذِي نَفْسِي بِيَدِهِ لَا يَأْخُذُ أَحَدُكُمْ مِنْهَا شَيْئًا ، وَزَادَ فِي حَدِيثِ سُفْيَانَ ، قَالَ : بَصُرَ عَيْنِي وَسَمِعَ أُذُنَايَ ، وَسَلُوا زَيْدَ بْنَ ثَابِتٍ ، فَإِنَّهُ كَانَ حَاضِرًا مَعِي ،
This tradition has been hanoed down through a different chain of transmitters on the authority of Hisham with aslight variation in the wording.
