Hadith 1235
‘Hakim bin Hizam (may Allah be pleased with him) says that’ the Messenger of Allah (peace and blessings of Allah be upon him) forbade me from selling something which is not in my possession. © Imam Tirmidhi says:
1- Waki’ has narrated this hadith through the route: «عن يزيد بن إبراهيم عن ابن سيرين عن أيوب عن حكيم بن حزام» and has not mentioned the intermediary of Yusuf bin Mahak. The narration of ‘Abd al-Samad is more authentic (in which Ibn Sirin is mentioned). And Yahya bin Abi Kathir has narrated this hadith through the route: «عن يعلى بن حكيم عن يوسف بن ماهك عن عبد الله بن عصمة عن حكيم بن حزام عن النبي صلى الله عليه وسلم»,
2- Most of the people of knowledge act upon this hadith; they consider it disliked to sell something which a person does not possess.

Narrated from Abdullah bin Abbas (may Allah be pleased with them) that the Prophet Muhammad (peace and blessings be upon him) said: "When a mukatab slave becomes entitled to blood money or inheritance, he will receive a share according to the extent to which he has been freed." He also said: "The mukatab will be given blood money in proportion to the amount of the contract price he has paid, and for the remainder, he will be given the blood money of a slave." © Imam Tirmidhi says:
1- The hadith of Ibn Abbas (may Allah be pleased with them) is Hasan (good).
2- Similarly, Yahya bin Abi Kathir narrated from Ikrimah, and Ikrimah from Ibn Abbas, and Ibn Abbas from the Prophet Muhammad (peace and blessings be upon him).
3- In this chapter, there is also a narration from Umm Salamah (may Allah be pleased with her).
4- However, Khalid al-Hadha also narrated from Ikrimah (but according to him), Ikrimah narrated from the statement of Ali (may Allah be pleased with him).
5- Some of the people of knowledge among the Companions and others act upon this hadith. And most of the people of knowledge among the Companions and others say that as long as even one dirham remains upon the mukatab, he is a slave. This is also the saying of Sufyan Thawri, Shafi'i, Ahmad, and Ishaq bin Rahwayh.
Hadith 1298
'Abdullah bin Abbas (may Allah be pleased with them) says that the Messenger of Allah (peace and blessings of Allah be upon him) said: "An evil example is not suitable for us; the one who takes back a gift is like a dog that vomits and then licks it." 1.

Zaid bin Thabit (may Allah be pleased with him) says that the Prophet Muhammad (peace and blessings of Allah be upon him) forbade Muhaqala and Muzabana, but he permitted the owners of ‘Araya to sell them by estimation for an equal amount of dates. __QUR_N__ Imam Tirmidhi says:
1- The hadith of Zaid bin Thabit (may Allah be pleased with him) has been narrated in this manner by Muhammad bin Ishaq. And Ayyub, Ubaidullah bin Umar, and Malik bin Anas have narrated from Nafi’, and Nafi’ from Ibn Umar, that the Prophet Muhammad (peace and blessings of Allah be upon him) forbade Muhaqala and Muzabana.
2- In this chapter, ahadith have also been reported from Abu Hurairah and Jabir (may Allah be pleased with them). And with this same chain, Ibn Umar narrated from Zaid bin Thabit, and he from the Prophet Muhammad (peace and blessings of Allah be upon him), that he permitted the sale of ‘Araya. And this is more authentic than the hadith of Muhammad bin Ishaq. __XREF_N__

Zaid bin Thabit (may Allah be pleased with him) says that the Messenger of Allah (peace and blessings of Allah be upon him) permitted the sale of ‘Araya by estimation.
© Imam Tirmidhi says:
1- This hadith is Hasan Sahih.
2- Some people of knowledge act upon this, among whom are Shafi’i, Ahmad, and Ishaq bin Rahwayh. These people say that among the things from which the Prophet (peace and blessings of Allah be upon him) forbade, ‘Araya is an exception, because he forbade Muhaqala and Muzabana. They have deduced from the hadith of Zaid bin Thabit and Abu Hurairah, and their opinion is that it is permissible to buy less than five wasqs.
3- According to some people of knowledge, its meaning is that the Prophet (peace and blessings of Allah be upon him) intended to give ease and allowance in this matter, because the owners of ‘Araya complained to him and said that apart from dried dates, they had nothing with which to buy fresh dates. So he permitted them to buy for less than five wasqs so that they could eat fresh dates.

Jabir (may Allah be pleased with him) reports that the Prophet Muhammad (peace and blessings be upon him) forbade the sale of Muhāqala, Muzābanah 1, Mukhabarah 2, and Mu'āwamah 3, and he permitted 'Ariyā 4. © Imam Tirmidhi says:

It is narrated from Imran bin Husain (may Allah be pleased with him) that the Prophet (peace and blessings of Allah be upon him) ransomed two Muslim men in exchange for one male polytheist prisoner. 1. Imam Tirmidhi says:
1- This hadith is Hasan Sahih (good and authentic),
2- Abu Qilabah's name is Abdullah bin Zaid Jarami,
3- Most of the scholars among the Companions and others act upon this, that the Imam has the choice to show kindness to whichever prisoner he wishes, to kill whomever he wishes, and to take ransom from whomever he wishes,
4- Some scholars have preferred killing over ransom,
5- Imam Awza'i says: I have received the information that this verse «فإما منا بعد وإما فداء» is abrogated and the verse: «واقتلوهم حيث ثقفتموهم» is its abrogator,
6- Ishaq bin Mansur says: I asked Imam Ahmad bin Hanbal: What do you consider better when a prisoner is captured, to kill him or to take ransom from him? He replied: If they can take ransom, there is no harm in it, and if they are killed, I see no harm in that either,
7- Ishaq bin Rahwayh says: In my view, shedding blood is better when it becomes well-known and most people desire it.
Hadith 1713
Hisham bin Amir (may Allah be pleased with him) says: On the day of Uhud, complaints were made to the Messenger of Allah (peace and blessings of Allah be upon him) about the wounds. He said: "Dig graves and make them spacious and good. Bury two or three men in one grave, and put the one who knows more Qur'an (closer) towards the Qiblah." Hisham bin Amir says: My father also passed away, so he was placed ahead of his two companions (i.e., closer to the Qiblah). © Imam Tirmidhi says:
