Hadith 931
حَدَّثَنَا
مُحَمَّدُ بْنُ عَبْدِ الْأَعْلَى الصَّنْعَانِيُّ، حَدَّثَنَا
عُمَرُ بْنُ عَلِيٍّ، عَنْ
الْحَجَّاجِ، عَنْ
مُحَمَّدِ بْنِ الْمُنْكَدِرِ، عَنْ
جَابِرٍ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سُئِلَ عَنِ الْعُمْرَةِ أَوَاجِبَةٌ هِيَ ؟ قَالَ : " لَا ، وَأَنْ تَعْتَمِرُوا هُوَ أَفْضَلُ " . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَهُوَ قَوْلُ بَعْضِ أَهْلِ الْعِلْمِ ، قَالُوا : الْعُمْرَةُ لَيْسَتْ بِوَاجِبَةٍ . وَكَانَ يُقَالُ : هُمَا حَجَّانِ : الْحَجُّ الْأَكْبَرُ يَوْمُ النَّحْرِ ، وَالْحَجُّ الْأَصْغَرُ الْعُمْرَةُ ، وقَالَ الشَّافِعِيُّ : الْعُمْرَةُ سُنَّةٌ ، لَا نَعْلَمُ أَحَدًا رَخَّصَ فِي تَرْكِهَا ، وَلَيْسَ فِيهَا شَيْءٌ ثَابِتٌ بِأَنَّهَا تَطَوُّعٌ ، وَقَدْ رُوِيَ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِإِسْنَادٍ ، وَهُوَ ضَعِيفٌ لَا تَقُومُ بِمِثْلِهِ الْحُجَّةُ ، وَقَدْ بَلَغَنَا عَنْ ابْنِ عَبَّاسٍ ، أَنَّهُ كَانَ يُوجِبُهَا . قَالَ أَبُو عِيسَى : كُلُّهُ كَلَامُ الشَّافِعِيِّ .
´Jabir narrated that:` The Prophet was asked about whether Umrah was obligatory? He said: "No. But if you perform Umrah it is more virtuous."
Hadith 1286
حَدَّثَنَا
أَبُو سَلَمَةَ يَحْيَى بْنُ خَلَفٍ، أَخْبَرَنَا
عُمَرُ بْنُ عَلِيٍّ الْمُقَدَّمِيُّ، عَنْ
هِشَامِ بْنِ عُرْوَةَ، عَنْ
أَبِيهِ، عَنْ
عَائِشَةَ، " أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى أَنَّ الْخَرَاجَ بِالضَّمَانِ " . قَالَ : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ غَرِيبٌ مِنْ حَدِيثِ هِشَامِ بْنِ عُرْوَةَ . قَالَ أَبُو عِيسَى : وَقَدْ رَوَى
مُسْلِمُ بْنُ خَالِدٍ الزَّنْجِيُّ هَذَا الْحَدِيثَ ، عن
هِشَامِ بْنِ عُرْوَةَ، وَرَوَاهُ
جَرِيرٌ، عنْ
هِشَامٍ أَيْضًا . وَحَدِيثُ جَرِيرٍ يُقَالُ : تَدْلِيسٌ دَلَّسَ فِيهِ جَرِيرٌ لَمْ يَسْمَعْهُ مِنْ هِشَامِ بْنِ عُرْوَةَ ، وَتَفْسِيرُ الْخَرَاجِ بِالضَّمَانِ ، هُوَ الرَّجُلُ يَشْتَرِي الْعَبْدَ ، فَيَسْتَغِلُّهُ ثُمَّ يَجِدُ بِهِ عَيْبًا ، فَيَرُدُّهُ عَلَى الْبَائِعِ ، فَالْغَلَّةُ لِلْمُشْتَرِي لِأَنَّ الْعَبْدَ لَوْ هَلَكَ هَلَكَ مِنْ مَالِ الْمُشْتَرِي ، وَنَحْوُ هَذَا مِنَ الْمَسَائِلِ يَكُونُ فِيهِ الْخَرَاجُ بِالضَّمَانِ .
‘Umm al-Mu’minin Aisha (may Allah be pleased with her) says that the Prophet Muhammad (peace and blessings of Allah be upon him) decided that the right to benefit is based on being liable as a guarantor. © Imam Tirmidhi says:
1- This hadith, narrated from Hisham bin ‘Urwah, is Hasan Sahih Gharib.
2- Imam Tirmidhi says: Muhammad bin Isma’il considered this hadith to be Gharib from the narration of ‘Umar bin ‘Ali. I asked: In your view, is there any tadlis in it? He said: No.
3- Muslim bin Khalid Zanji has narrated this hadith from Hisham bin ‘Urwah.
4- Jarir has also narrated it from Hisham.
5- And it is said that there is tadlis in Jarir’s hadith; Jarir has committed tadlis in it, he did not hear it from Hisham bin ‘Urwah.
6- The explanation of «الخراج بالضمان» is that a man buys a slave and makes him work for wages, then finds a defect in him and returns him to the seller; so the wages and benefit of the slave will belong to the buyer. Because if the slave had perished, the buyer’s wealth would have perished. In this and similar matters, the right to benefit is due to being liable as a guarantor.
Hadith 1447
حَدَّثَنَا
قُتَيْبَةُ , حَدَّثَنَا
عُمَرُ بْنُ عَلِيٍّ الْمُقَدَّمِيُّ , حَدَّثَنَا
الْحَجَّاجُ , عَنْ
مَكْحُولٍ , عَنْ
عَبْدِ الرَّحْمَنِ بْنِ مُحَيْرِيزٍ , قَالَ : سَأَلْتُ
فَضَالَةَ بْنَ عُبَيْدٍ , عَنْ تَعْلِيقِ الْيَدِ فِي عُنُقِ السَّارِقِ , أَمِنَ السُّنَّةِ هُوَ ؟ قَالَ : " أُتِيَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِسَارِقٍ , فَقُطِعَتْ يَدُهُ , ثُمَّ أَمَرَ بِهَا فَعُلِّقَتْ فِي عُنُقِهِ " , قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ لَا نَعْرِفُهُ إِلَّا مِنْ حَدِيثِ عُمَرَ بْنِ عَلِيٍّ الْمُقَدَّمِيِّ , عَنْ الْحَجَّاجِ بْنِ أَرْطَاةَ , وَعَبْدُ الرَّحْمَنِ بْنُ مُحَيْرِيزٍ : هُوَ أَخُو عَبْدِ اللَّهِ بْنِ مُحَيْرِيزٍ شَامِيٌّ .
´'Abdur-Rahman bin Muhariz said:` "I asked Fadalah bin 'Ubaid about hanging the hand around the neck of the thief: 'Is this from the Sunnah?' He said: 'A man came to the Messenger of Allah (ﷺ) with a thief so his hand was cut off, and then he ordered that it be hung around his neck.'"
Hadith 1689
'Abdullah bin Umar (may Allah be pleased with them both) says: On the day of the Battle of Hunayn, our condition was such that both groups of Muslims had turned their backs, and there were not even a hundred men with the Messenger of Allah (peace be upon him). © Imam Tirmidhi says:
1- This hadith is Hasan Gharib,
2- We know it from this chain only through the narration of Ubaidullah.
Hadith 2408
´Sahl bin Sa'd narrated that the Messenger of Allah (s.a.w) said:` "Whoever guarantees for me what is between his jaws and what is between his legs, I shall guarantee Paradise for him."
Hadith 2839
´Narrated 'Aishah:` that the Prophet (ﷺ) would change abhorrent names."
Hadith 2853
´Narrated 'Abdullah bin 'Amr:` that the Messenger of Allah (ﷺ) said: "Indeed Allah detests the excessive among men, who slaps his tongue around like the cow slaps his tongue."
