‘Abdullah bin ‘Umar (may Allah be pleased with them both) says: I heard the Messenger of Allah (peace and blessings of Allah be upon him) say: “Whoever buys a date-palm tree after it has been pollinated («تأبیر»), its fruit will belong to the seller, unless the buyer stipulates (the fruit at the time of purchase). And whoever buys a slave who possesses property, his property will belong to the seller, unless the buyer stipulates (the property at the time of purchase).” © Imam Tirmidhi says:
1- The hadith of Ibn ‘Umar (may Allah be pleased with them both) is Hasan Sahih.
2- Similarly, it is narrated through other chains with the isnad of «عن الزهري عن سالم عن ابن عمر عن النبي صلى الله عليه وسلم» that he said: “Whoever buys a date-palm tree after it has been pollinated, its fruit will belong to the seller, unless the buyer stipulates (the fruit along with the tree). And whoever buys a slave who possesses property, his property will belong to the seller, unless the buyer stipulates (the property along with the slave).”
3- This is also narrated from Nafi‘, who narrated from Ibn ‘Umar, and Ibn ‘Umar narrated from the Prophet (peace and blessings of Allah be upon him) that he said: “Whoever buys a date-palm tree that has been pollinated, its fruit will belong to the seller, unless the buyer stipulates (the fruit along with the tree).”
4- It is narrated from Nafi‘, who narrates from Ibn ‘Umar, who says: Whoever sells a slave who possesses property, his property will belong to the seller, unless the buyer stipulates (the property along with the slave).
5- Similarly, ‘Ubaydullah bin ‘Umar and others have narrated both hadiths from Nafi‘.
6- Also, some people have narrated this hadith from Nafi‘, Nafi‘ from Ibn ‘Umar, and he from the Prophet (peace and blessings of Allah be upon him).
7- ‘Ikrimah bin Khalid narrated from Ibn ‘Umar, and Ibn ‘Umar from the Prophet (peace and blessings of Allah be upon him), similar to the hadith of Salim.
8- Muhammad bin Isma‘il al-Bukhari says: The hadith of al-Zuhri, which he narrated via «عن سالم عن أبيه عن النبي صلى الله عليه وسلم», is the most authentic in this chapter.
9- Some of the people of knowledge act upon this hadith. And this is also the view of al-Shafi‘i, Ahmad, and Ishaq bin Rahwayh.
10- In this chapter, there is also a narration from Jabir (may Allah be pleased with him).
