Hadith 1474
حَدَّثَنَا
مُحَمَّدُ بْنُ يَحْيَى , غَيْرُ وَاحِدٍ , قَالُوا : حَدَّثَنَا
أَبُو عَاصِمٍ، عَنْ
وَهْبٍ أَبِي خَالِدٍ , قَالَ : حَدَّثَتْنِي
أُمُّ حَبِيبَةَ بِنْتُ الْعِرْبَاضِ بْنِ سَاريةَ، عَنْ
أَبِيهَا , أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " نَهَى يَوْمَ خَيْبَرَ عَنْ لُحُومِ كُلِّ ذِي نَابٍ مِنَ السَّبُعِ , وَعَنْ كُلِّ ذِي مِخْلَبٍ مِنَ الطَّيْرِ , وَعَنْ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ , وَعَنِ الْمُجَثَّمَةِ , وَعَنِ الْخَلِيسَةِ , وَأَنْ تُوطَأَ الْحَبَالَى حَتَّى يَضَعْنَ مَا فِي بُطُونِهِنَّ " , قَالَ مُحَمَّدُ بْنُ يَحْيَى : سُئِلَ أَبُو عَاصِمٍ عَنِ الْمُجَثَّمَةِ , قَالَ : أَنْ يُنْصَبَ الطَّيْرُ , أَوِ الشَّيْءُ فَيُرْمَى , وَسُئِلَ عَنِ الْخَلِيسَةِ , فَقَالَ : الذِّئْبُ , أَو السَّبُعُ يُدْرِكُهُ الرَّجُلُ فَيَأْخُذُهُ مِنْهُ فَيَمُوتُ فِي يَدِهِ قَبْلَ أَنْ يُذَكِّيَهَا .
´Narrated Umm Habibah bint Al-'Irbad:` From her father: "On the day of Khaibar, the Messenger of Allah (ﷺ) prohibited eating the meat of every predator that has canine teeth, the meat of every bird that has talons, the meat of the domestic donkey, the Mujath-thamah, the Khalisah, and from having relations with a pregnant slave until she gives birth to what is in her womb." Muhammad bin Yahya said: "Abu 'Asim was asked about Mujath-thamah and he said: "To ensnare a bird or something and then shoot it." He was asked about Khalisah, so he said: "(Prey) that a man finds with a wolf or a predator, then he takes it from him but it dies in his hand before it can be slaughtered."
Hadith 1564
حَدَّثَنَا
مُحَمَّدُ بْنُ يَحْيَى النَّيْسَابُورِيُّ، حَدَّثَنَا
أَبُو عَاصِمٍ النَّبِيلُ، عَنْ
وَهْبٍ بْنِ خَالِدٍ، قَالَ : حَدَّثَتْنِي
أُمُّ حَبِيبَةَ بِنْتُ عِرْبَاضِ بْنِ سَارِيَةَ، أَنَّ
أَبَاهَا أَخْبَرَهَا ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " نَهَى أَنْ تُوطَأَ السَّبَايَا حَتَّى يَضَعْنَ مَا فِي بُطُونِهِنَّ " ، قَالَ أَبُو عِيسَى : وَفِي الْبَاب ، عَنْ رُوَيْفِعِ بْنِ ثَابِتٍ ، وَحَدِيثُ عِرْبَاضٍ حَدِيثٌ غَرِيبٌ ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ ، وقَالَ الْأَوْزَاعِيُّ : إِذَا اشْتَرَى الرَّجُلُ الْجَارِيَةَ مِنَ السَّبْيِ وَهِيَ حَامِلٌ ، فَقَدْ رُوِيَ عَنْ عُمَرَ بْنِ الْخَطَّابِ ، أَنَّهُ قَالَ : لَا تُوطَأُ حَامِلٌ حَتَّى تَضَعَ ، قَالَ الْأَوْزَاعِيُّ : وَأَمَّا الْحَرَائِرُ ، فَقَدْ مَضَتِ السُّنَّةُ فِيهِنَّ بِأَنْ أُمِرْنَ بِالْعِدَّةِ ، حَدَّثَنِي بِذَلِكَ عَلِيُّ بْنُ خَشْرَمٍ ، قَالَ : حَدَّثَنَا عِيسَى بْنُ يُونُسَ ، عَنْ الْأَوْزَاعِيِّ ، بِهَذَا الْحَدِيثِ .
It is narrated from ‘Irbad bin Sariyah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings of Allah be upon him) forbade having intercourse with captive pregnant women until they give birth to the children in their wombs 1. © Imam Tirmidhi says:
1- The hadith of ‘Irbad (may Allah be pleased with him) is gharib (rare),
2- In this chapter, there is also a narration from Ruwaifi‘ bin Thabit (may Allah be pleased with him),
3- The people of knowledge act upon this, Al-Awza‘i says: When a person buys a slave woman from among the captive women and she is pregnant, there is a narration from ‘Umar bin Khattab, he said: If she is pregnant, intercourse should not take place with her until she gives birth,
4- Al-Awza‘i says: As for free women, the established Sunnah is that they are ordered to observe the waiting period (‘iddah).
Hadith 2676
حَدَّثَنَا
عَلِيُّ بْنُ حُجْرٍ، حَدَّثَنَا
بَقِيَّةُ بْنُ الْوَلِيدِ، عَنْ
بَحِيرِ بْنِ سَعْدٍ، عَنْ
خَالِدِ بْنِ مَعْدَانَ، عَنْ
عَبْدِ الرَّحْمَنِ بْنِ عَمْرٍو السُّلَمِيِّ، عَنِ
الْعِرْبَاضِ بْنِ سَارِيَةَ، قَالَ : وَعَظَنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَوْمًا بَعْدَ صَلَاةِ الْغَدَاةِ مَوْعِظَةً بَلِيغَةً ذَرَفَتْ مِنْهَا الْعُيُونُ وَوَجِلَتْ مِنْهَا الْقُلُوبُ ، فَقَالَ رَجُلٌ : إِنَّ هَذِهِ مَوْعِظَةُ مُوَدِّعٍ ، فَمَاذَا تَعْهَدُ إِلَيْنَا يَا رَسُولَ اللَّهِ ؟ قَالَ : " أُوصِيكُمْ بِتَقْوَى اللَّهِ ، وَالسَّمْعِ ، وَالطَّاعَةِ ، وَإِنْ عَبْدٌ حَبَشِيٌّ فَإِنَّهُ مَنْ يَعِشْ مِنْكُمْ يَرَى اخْتِلَافًا كَثِيرًا ، وَإِيَّاكُمْ وَمُحْدَثَاتِ الْأُمُورِ فَإِنَّهَا ضَلَالَةٌ ، فَمَنْ أَدْرَكَ ذَلِكَ مِنْكُمْ فَعَلَيْهِ بِسُنَّتِي وَسُنَّةِ الْخُلَفَاءِ الرَّاشِدِينَ الْمَهْدِيِّينَ ، عَضُّوا عَلَيْهَا بِالنَّوَاجِذِ " , قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ , وَقَدْ رَوَى ثَوْرُ بْنُ يَزِيدَ ، عَنْ خَالِدِ بْنِ مَعْدَانَ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ عَمْرٍو السُّلَمِيِّ ، عَنْ الْعِرْبَاضِ بْنِ سَارِيَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَحْوَ هَذَا.
´Narrated Al-'Irbad bin Sariyah:` "One day after the morning Salat, the Messenger of Allah (ﷺ) exhorted us to the extent that the eyes wept and the hearts shuddered with fear. A man said: 'Indeed this is a farewell exhortation. [So what] do you order us O Messenger of Allah?' He said: 'I order you to have Taqwa of Allah, and to listen and obey, even in the case of an Ethiopian slave. Indeed, whomever among you lives, he will see much difference. Beware of the newly invented matters, for indeed they are astray. Whoever among you sees that, then he must stick to my Sunnah and the Sunnah of the rightly guided Khulafa', cling to it with the molars.'"
Hadith 2676
`With this chain also, a similar hadith is narrated from Arbad bin Sariyah, may Allah be pleased with him. © Imam Tirmidhi says:
1- The kunyah of Arbad bin Sariyah is Abu Najeeh.
2- This hadith is also narrated in a similar way through the chain: «حجر بن حجر عن عرباض بن سارية عن النبي صلى الله عليه وسلم».
Hadith 2921
´Narrated 'Irbad bin Sariyah:` that the Prophet (ﷺ) would recite the Musabbihat (Chapters 17, 57, 59, 61, 62, 64 & 87) before sleep and say "Indeed there is an Ayah in them that is better than one thousand Ayat."
Hadith 3406
´Ar-Irbad bin Sariyah (ra) narrated that:` The Prophet (ﷺ) would not sleep until he had recited Al-Musabbihat, and he would say: “In them is an Ayah that is better than a thousand Ayah.”
