بَابُ : الْعَبْدِ يُبَاعُ وَيَسْتَثْنِي الْمُشْتَرِي مَالَهُ
Chapter: When A Slave Is Bought Or sold But His Possessions Are Exempt
Hadith 4640
أَخْبَرَنَا إِسْحَاق بْنُ إِبْرَاهِيمَ , قَالَ : أَنْبَأَنَا سُفْيَانُ , عَنْ الزُّهْرِيِّ , عَنْ سَالِمٍ , عَنْ أَبِيهِ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " مَنِ ابْتَاعَ نَخْلًا بَعْدَ أَنْ تُؤَبَّرَ فَثَمَرَتُهَا لِلْبَائِعِ , إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ , وَمَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلْبَائِعِ , إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ " .
´It was narrated from Salim, from his father that the Prophet said:` "Whoever buys a date-palm tree after it has been pollinated, its fruits belong to the seller, unless the purchaser has stipulated otherwise. And whoever buys a slave who has wealth, his wealth belongs to the seller, unless the purchaser has stipulated otherwise. "(sahih)
