Hadith 5711

قَالَ الْحَارِثُ بْنُ مِسْكِينٍ قِرَاءَةً عَلَيْهِ وَأَنَا أَسْمَعُ , عَنْ ابْنِ الْقَاسِمِ , قَالَ : حَدَّثَنِي مَالِكٌ , عَنْ ابْنِ شِهَابٍ , عَنْ السَّائِبِ بْنِ يَزِيدَ أَنَّهُ أَخْبَرَهُ , أَنَّ عُمَرَ بْنَ الْخَطَّابِ خَرَجَ عَلَيْهِمْ , فَقَالَ : " إِنِّي وَجَدْتُ مِنْ فُلَانٍ رِيحَ شَرَابٍ فَزَعَمَ أَنَّهُ شَرَابُ الطِّلَاءِ , وَأَنَا سَائِلٌ عَمَّا شَرِبَ , فَإِنْ كَانَ مُسْكِرًا جَلَدْتُهُ " , فَجَلَدَهُ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ الْحَدَّ تَامًّا .
´It was narrated from As-Sa'ib that :` 'Umar bin Al-Khattab went out t them and said: "I noticed the smell of drink on so-and-so, and he said that he had drunk At-Tila' (thickened juice of grapes). I am asking about what he drank. If it was an intoxicant I will flog him." So 'Umar bin Al-Khattab, may Allah be pleased with him, flogged him, carrying out the Hadd punishment in full.

(1) This narration proves that Umar radi Allahu anhu considered every intoxicating drink to be forbidden (haram) and liable to the prescribed punishment (hadd), even though this drink, according to the Hanafi definition, is not khamr (wine). Yet, he enforced the hadd for drinking it, even though the drinker did not become intoxicated. For if he had become intoxicated, there would have been no need to investigate whether the drink was intoxicating or not. It is thus clear that, according to him, any intoxicating drink is forbidden and liable to the hadd, whether in small or large quantity, whether it causes intoxication or not. Therefore, attributing the drinking of such a beverage to him is not correct.

(2) "Such-and-such person" refers to his son, Ubaydullah ibn Umar. He was not a Companion (Sahabi). This is explicitly stated in Sahih Bukhari.

(3) "The full hadd was enforced"—no concession was given. Radi Allahu anhu wa ardah.

(4) "Tila’" is grape juice that is dried over fire. When two-thirds of it dries up and it becomes like a paste, it is then used. Generally, it does not cause intoxication, so it is permissible. However, if it does cause intoxication, then it is forbidden (haram).
