Brief Explanation
1؎: The disagreement is that Abu 'Awn narrated «المسكر» (with a dammah on the meem, a kasrah on the seen, and a kasrah on the kaf) instead of «السكر» (with a dammah on the seen and sukoon on the kaf) («ما أسكر» as is in the next narration), which is also contrary in meaning to the narration of Ibn Shubrumah. The meaning of the word «السكر» is that "that quantity upon which intoxication occurs is forbidden, not before that," and the meaning of the word «المسكر» (or «ما أسكر» in the next narration) is that any beverage from which intoxication occurs (even if not from a small amount) is forbidden. And in terms of chain of transmission, the narration of Abu 'Awn is closer to correctness compared to the narration of Ibn Shubrumah. Therefore, the reasoning of Imam Tahawi and others based on the narration of Ibn Shubrumah is not correct. (See: al-Hawashi al-Jadidah lil-Fanjabi, also al-Fath 10/65)
