Hadith 5680

أَخْبَرَنَا هَنَّادُ بْنُ السَّرِيِّ ، عَنْ أَبِي الْأَحْوَصِ ، عَنْ سِمَاكٍ ، عَنِ الْقَاسِمِ بْنِ عَبْدِ الرَّحْمَنِ ، عَنْ أَبِيهِ ، عَنْ أَبِي بُرْدَةَ بْنِ نِيَارٍ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " اشْرَبُوا فِي الظُّرُوفِ وَلَا تَسْكَرُوا " . قَالَ أَبُو عَبْد الرَّحْمَنِ : وَهَذَا حَدِيثٌ مُنْكَرٌ ، غَلِطَ فِيهِ أَبُو الْأَحْوَصِ سَلَّامُ بْنُ سُلَيْمٍ لَا نَعْلَمُ أَنَّ أَحَدًا تَابَعَهُ عَلَيْهِ مِنْ أَصْحَابِ سِمَاكِ بْنِ حَرْبٍ , وَسِمَاكٌ لَيْسَ بِالْقَوِيِّ ، وَكَانَ يَقْبَلُ التَّلْقِينَ . قَالَ أَحْمَدُ بْنُ حَنْبَلٍ : كَانَ أَبُو الْأَحْوَصِ يُخْطِئُ فِي هَذَا الْحَدِيثِ . خَالَفَهُ شَرِيكٌ فِي إِسْنَادِهِ وَفِي لَفْظِهِ .
´It was narrated that Abu Burdah bin Niyar said:` "The Messenger of Allah [SAW] said: 'Drink from vessels but do not become intoxicated.'"

(1) This hadith is munkar, meaning it is weak and contrary to authentic (sahih) ahadith. Other trustworthy narrators do not report it in this manner. Only Abu al-Ahwas narrates it, and according to Imam Ahmad ibn Hanbal rahimahullah, he is weak. Furthermore, his teacher, Simak, is also not strong; rather, he used to accept what people suggested to him.

(2) By "some people," the Hanafis are meant. Their argument is based on the phrase "do not become intoxicated," as if drinking is not prohibited but becoming intoxicated is. However, this is not correct because this narration is weak, while in other narrations the wording is: "But do not drink intoxicating beverages," meaning that nabidh (fermented drink) can be prepared in any vessel, but it should not become intoxicating. Also, the meaning of these words can be in accordance with other narrations: that you should not drink anything intoxicating, because without drinking, one cannot become intoxicated. The meaning of a single narration cannot be interpreted in opposition to other authentic narrations, nor can numerous other narrations be abandoned due to a single weak narration.
