´It was narrated that Ibn 'Umar said:` "Whoever drinks Khamr and does not get intoxicated, his Salah will not be accepted so long as any trace of it remains in his belly or his veins, and if he dies he will die a Kafir. If he becomes intoxicated his Salah will not be accepted for 40 nights, and if he dies during them, he will die a Kafir." (Sahih Mawquf)

1؎: Because even a single drop of alcohol (which does not cause intoxication) is forbidden. The Prophetic statement is: "Whatever drink, the greater part of which causes intoxication, then its lesser part is also forbidden."
2؎: Just as prayer is not accepted alongside disbelief, similarly, if alcohol is present in the stomach, the prayer will not be accepted. Thus, death in this state is the death of a disbeliever, because one who does not pray is a disbeliever, as is the fatwa of the verifying scholars.
«خالفه يزيد بن أبي زياد» In the previous narration, «يزيد بن أبي زياد» disagreed with Fudayl.

(1) Imam Nasa’i rahimahullah’s intent is that when Fudayl bin ‘Amr narrated this narration, he said: “from Mujahid, from Ibn ‘Umar,” i.e., he considered it as being from the Musnad of ‘Abdullah bin ‘Umar radi Allahu anhu. Whereas when Yazid bin Abu Ziyad narrated this from Mujahid, he said: “from Ibn ‘Umar,” i.e., he narrated it as being from the Musnad of ‘Abdullah bin ‘Umar radi Allahu anhu. And Allah knows best.
(2) The death of a disbeliever: because his prayer is not accepted, he becomes like a disbeliever, and this is an extremely repugnant state. May Allah protect us from it.
