يَعْقُوبُ بْنُ إِبْرَاهِيمَ ، قَالَ : حَدَّثَنَا

الشَّعْبِيُّ ، عَنْ
ابْنِ عُمَرَ ، قَالَ : سَمِعْتُ
عُمَرَ رَضِيَ اللَّهُ عَنْهُ يَخْطُبُ عَلَى مِنْبَرِ الْمَدِينَةِ ، فَقَالَ : " أَيُّهَا النَّاسُ , أَلَا إِنَّهُ نَزَلَ تَحْرِيمُ الْخَمْرِ يَوْمَ نَزَلَ ، وَهِيَ مِنْ خَمْسَةٍ : مِنَ الْعِنَبِ ، وَالتَّمْرِ ، وَالْعَسَلِ ، وَالْحِنْطَةِ ، وَالشَّعِيرِ ، وَالْخَمْرُ مَا خَامَرَ الْعَقْلَ " .
´It was narrated that Ibn 'Umar said:` "I heard 'Umar, may Allah be pleased with him, delivering a Khutbah on the Minbar of Al-Madinah and he said: 'O people, on the day that the prohibition of Khamr was revealed, it was made from five things: From grapes, dates, honey, wheat and barley. Khamr is that which overcomes the mind.'"

(1) "To cover the intellect" means that the drinker's intellect does not function; he loses awareness of himself and of his speech and actions. He babbles nonsense and does absurd things. In reality, intellect is the distinguishing feature of a human being—how can something that destroys the intellect ever be permissible?
(2) The explicit fatwa of Umar radi Allahu anhu in front of all the noble Companions radi Allahu anhum is sufficient to open the eyes of the people of opinion (Ahl al-Ra’y): that intoxicants can be prepared from things other than grapes as well, and all of them will be subject to the ruling of khamr (wine), meaning that even a single sip is forbidden. Who could be a greater jurist (faqih) and mujtahid among the Companions than Umar radi Allahu anhu? And the people of opinion (Ahl al-Ra’y) even abandon hadith in favor of the statement of a jurist Companion—so will they not abandon their own opinion? In fact, this issue becomes one of consensus (ijma‘), because none of the Companions refuted the statement of Umar radi Allahu anhu—what more is needed?
