Hadith 5547

أَخْبَرَنَا سُوَيْدُ بْنُ نَصْرٍ ، قَالَ : أَنْبَأَنَا عَبْدُ اللَّهِ ، عَنْ سُفْيَانَ ، عَنْ مُحَارِبِ بْنِ دِثَارٍ ، قَالَ : سَمِعْتُ جَابِرَ بْنَ عَبْدِ اللَّهِ ، قَالَ : " الْبُسْرُ وَالتَّمْرُ خَمْرٌ " . رَفَعَهُ الْأَعْمَشُ .
´Jabir bin 'Abdullah said:` "Unripe dates and dried dates are Khamr." Al-A'mash narrated it in Marfu' form.

Imam al-Nasa’i rahimahullah wishes to clarify that Shu’bah, Sufyan, and A’mash—all three—have narrated this report from Muharib ibn Dithar. Shu’bah and Sufyan have narrated it as mawquf, that is, as a statement of Jabir radi Allahu anhu, whereas A’mash, differing from both of them, has narrated it as marfu’, that is, as a statement of the Messenger of Allah sallallahu alayhi wa sallam, as becomes clearly evident upon examining the chain of the following narration: 5548. This narration is authentic and correct in both its mawquf and marfu’ forms. And Allah knows best.
