Hadith 5107

أَخْبَرَنَا حُمَيْدُ بْنُ مَسْعَدَةَ ، قَالَ : حَدَّثَنَا يَزِيدُ بْنُ زُرَيْعٍ ، قَالَ : حَدَّثَنَا ابْنُ عَوْنٍ ، عَنِ الشَّعْبِيِّ ، عَنْ الْحَارِثِ ، قَالَ : " لَعَنَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ آكِلَ الرِّبَا وَمُوكِلَهُ ، وَشَاهِدَهُ وَكَاتِبَهُ ، وَالْوَاشِمَةَ ، وَالْمُوتَشِمَةَ " , قَالَ : " إِلَّا مِنْ دَاءٍ " , فَقَالَ : " نَعَمْ ، وَالْحَالُّ وَالْمُحَلَّلُ لَهُ ، وَمَانِعُ الصَّدَقَةِ ، وَكَانَ يَنْهَى عَنِ النَّوْحِ " وَلَمْ يَقُلْ لَعَنَ .
´It was narrated from Ibn 'Awn, from Ash-Sha'bi, from Al-Harith, who said:` "The Messenger of Allah [SAW] cursed the one who consumes Riba, the one who pays it, the one who writes it down and the one who witnesses it; the woman who does tattoos and the woman who has that done"- he said: "Unless it is done as a remedy;" he said: "Yes"- "the man who married a woman in order to divorce her so that she may go back to her first husband and the man (the first husband) for whom that is done; and the one who withholds Sadaqah (Zakah). And he used to forbid wailing (in mourning), but he did not say 'cursed'"

(1) "Halalah": A woman who has been given a third divorce becomes permanently unlawful (haram) for the husband who divorced her, except if she marries another husband and there too the marriage does not last, rather she is divorced or this husband passes away; then, after the completion of her waiting period (‘iddah), she can become lawful (halal) again for the first husband. However, if the second husband marries her with the intention of making her lawful for the first husband, then this is unlawful (haram), and it is making something prohibited by Shari‘ah lawful through a legal trick (hiylah). And using a trick to make the unlawful lawful is itself unlawful. The one who performs halalah is the second husband, and the one who arranges for it is the first husband.

(2) "No mention of curse": That is, wailing (niyahah) is indeed unlawful (haram), but the word "curse" (la‘nah) has not been mentioned for this act.
