Brief Explanation
1؎ : The statement of Imam Abu Hanifah is in accordance with this hadith, but this hadith is weak due to being disconnected (munqati‘). According to the majority (jumhur), even after the prescribed punishment (hadd) is carried out, compensation (ta‘wān) for the stolen property will be taken, because the wealth of a Muslim is unlawful for another Muslim except through legitimate means (legitimate means being: purchase, gift and donation, inheritance, salary, etc.). Therefore, it is necessary to take the stolen property from the thief and return it to its owner; if it is present, then that is sufficient, otherwise compensation will be taken.
