Hadith 4879

أَخْبَرَنَا عَبْدُ الرَّحْمَنِ بْنُ مُحَمَّدِ بْنِ سَلَّامٍ ، قَالَ : حَدَّثَنَا أَبُو أُسَامَةَ ، قَالَ : أَخْبَرَنِي ابْنُ الْمُبَارَكِ ، عَنْ مَعْمَرٍ , عَنْ بَهْزِ بْنِ حَكِيمٍ , عَنْ أَبِيهِ ، عَنْ جَدِّهِ : أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " حَبَسَ نَاسًا فِي تُهْمَةٍ " .
´It was narrated from Bahz bin Hakim, from his father, from his grandfather, that:` the Messenger of Allah detained some people who were under suspicion

For investigation, not as a punishment, because until the accusation against the accused is proven, he does not become a criminal. And during detention for investigation, he cannot be subjected to torture; otherwise, retributive action (qisas) will be taken against the one who commits the torture.
