´It was narrated from Al- Qasim bin Rabi'ah that the Messenger jof Allah said:` "The accident that resembles on purpose, meaning (killing) with a stick or a whip, (for which the Diyah is) one hundred camels, of which forty should be (pregnant she-camels), with their young in their wombs."

(1) In some of the aforementioned narrations, the word ‘intentional’ (ʿamdan) appears alongside accidental killing (khaṭāʾ). Here, what is meant is also ‘quasi-intentional’ (shibh ʿamd), because intentional killing (qatl ʿamd) cannot be accidental killing (qatl khaṭāʾ); these are opposites of each other. Therefore, what is meant is ‘quasi-intentional’—that is, what appears outwardly to be intentional, but in reality is accidental, because the killer did not intend to kill, but rather to strike or beat. The killing occurred by mistake (khaṭāʾ).
(2) Regarding the blood money (diyah) for quasi-intentional killing (qatl shibh ʿamd), it has been stated that forty of the camels should be pregnant, but the remaining sixty have not been specified here. However, in other hadiths it is mentioned that thirty should be hiqqah (three-year-old she-camels entering their fourth year) and thirty should be jadhaʿah (four-year-old she-camels entering their fifth year). In the case of intentional killing (qatl ʿamd), if pardon is granted, then blood money (diyah) will be due: thirty hiqqah, thirty jadhaʿah, and forty pregnant (five- to eight-year-old) she-camels.
