Hadith 4748

أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ ، قَالَ : حَدَّثَنَا الْحَجَّاجُ بْنُ مِنْهَالٍ ، قَالَ : حَدَّثَنَا هَمَّامٌ ، عَنْ قَتَادَةَ ، عَنْ أَبِي حَسَّانَ ، قَالَ : قَالَ عَلِيٌّ : مَا عَهِدَ إِلَيَّ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِشَيْءٍ دُونَ النَّاسِ إِلَّا فِي صَحِيفَةٍ فِي قِرَابِ سَيْفِي ، فَلَمْ يَزَالُوا بِهِ حَتَّى أَخْرَجَ الصَّحِيفَةَ , فَإِذَا فِيهَا : " الْمُؤْمِنُونَ تَكَافَأُ دِمَاؤُهُمْ يَسْعَى بِذِمَّتِهِمْ أَدْنَاهُمْ ، وَهُمْ يَدٌ عَلَى مَنْ سِوَاهُمْ ، لَا يُقْتَلُ مُؤْمِنٌ بِكَافِرٍ ، وَلَا ذُو عَهْدٍ فِي عَهْدِهِ " .
´It was narrated that Ash-Sha'bi said:` "I heard Abu Juhaifah say: 'We asked 'Ali: "Do you have anything from the Messenger of Allah apart from the Qur'an?" He said: "No, by the One who splits the seeds and creates the soul, unless Allah gives a slave understanding of His Book, or except this sheet." I said: "What is in the sheet?" He said: "In it are (the regulations concerning) blood money and the freeing of captives and (the rule) that no Muslim should be killed for killing a disbeliever."

(2) "In this writing"—and these matters were not exclusive to Ali radi Allahu anhu or the Ahl al-Bayt, but common people also knew them.
(3) "Freeing a prisoner"—the intended meaning is a prisoner who has fallen into the captivity of disbelievers or is innocently imprisoned by the government. It is not permissible to free a guilty prisoner who has been detained for a crime; however, it is permissible to assist him with food and clothing, or to help his family with their food and other needs. Sometimes, some people are imprisoned due to unpaid debts. To pay off their debt and thereby free them is also a virtuous act.
