Hadith 4618

أَخْبَرَنَا عُبَيْدُ اللَّهِ بْنُ سَعِيدٍ , قَالَ : حَدَّثَنَا يَحْيَى , عَنْ شُعْبَةَ , عَنْ عَبْدِ اللَّهِ بْنِ أَبِي الْمُجَالِدِ , قَالَ : سَأَلْتُ ابْنَ أَبِي أَوْفَى : عَنِ السَّلَفِ , قَالَ : " كُنَّا نُسْلِفُ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ , وَأَبِي بَكْرٍ , وَعُمَرَ فِي الْبُرِّ , وَالشَّعِيرِ , وَالتَّمْرِ إِلَى قَوْمٍ لَا أَدْرِي أَعِنْدَهُمْ أَمْ لَا " , وَابْنُ أَبْزَى , قَالَ : مِثْلَ ذَلِكَ .
´It was narrated that 'Abdullah Ibn Abi Awfa about paying in advance. He said:` 'We used to pay in advance during the time of the Messenger of Allah and Abu Bakr and 'Umar, for wheat, barley and dates, paying people whom we did not know if they had those things or not.'''Ibn Abza said meaning, similarly.

(1) Bay‘ salam is permissible. During the golden era of the Messenger (sallallahu alayhi wa sallam), Sayyiduna Abu Bakr, and Sayyiduna ‘Umar al-Faruq (radi Allahu anhu), bay‘ salam used to be practiced. Other noble Companions (radi Allahu anhum) also used to engage in this transaction.

(2) Bay‘ salam can be conducted in things that are not present at the time of sale; however, it is necessary that the item be present at the time of delivery in any case.

(3) Just as it is permissible to conduct ordinary trade and buying and selling with dhimmis and other non-Muslims, similarly, it is also permissible to conduct bay‘ salam with them.

(4) Bay‘ salam or salaf is one and the same thing: the buyer gives the seller the money in advance and agrees with him upon the quantity, type, and price of the grain (or whatever is intended to be purchased), and fixes the time for the delivery of the grain, even if that grain has not yet arrived in the market or has not yet been sold. The money can be given even a year or two in advance. This type of sale is a necessity for people because landowners and farmers need money in advance for the expenses of the crop; therefore, this sale has been permitted. The person with whom the transaction is made may be a farmer or a non-farmer, because he can also provide it by purchasing. Some details of this issue have already been mentioned in Hadith number 4615, Benefit number 5, and Hadith number 4617.

Hadith Commentary:
(1)
Both the words "salam" and "salaf" have the same meaning, that is, to make an advance purchase of something: the price is paid in advance, and then after a specified period, the item is received according to the agreed weight, measure, or quantity.

(2)
Those from whom grain and similar goods were purchased were not asked whether they themselves engaged in farming or not. This was of no concern. They could procure the goods from wherever they wished and deliver them at the appointed time. However, if the transaction is conducted in such a specified manner that, for example, a certain quantity of wheat is required from a particular field which is not present there at the time, then such a transaction is not permissible according to the Shari‘ah.
