Hadith 4576

حَدَّثَنَا قُتَيْبَةُ , عَنْ مَالِكٍ , عَنْ زَيْدِ بْنِ أَسْلَمَ , عَنْ عَطَاءِ بْنِ يَسَارٍ , أَنَّ مُعَاوِيَةَ بَاعَ سِقَايَةً مِنْ ذَهَبٍ , أَوْ وَرِقٍ بِأَكْثَرَ مِنْ وَزْنِهَا , فَقَالَ أَبُو الدَّرْدَاءِ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَنْهَى عَنْ مِثْلِ هَذَا , إِلَّا مِثْلًا بِمِثْلٍ " .
´It was narrated from 'Ata' bin Yasir that:` Muawiyah sold a cup of gold or silver for more than its weight. Abu Ad-Darda' said: "I heard the Messenger of Allah forbid such transactions unless it was like for like."

(1) The buying and selling of gold for gold or silver for silver is permissible on the condition that there is equality on both sides and the transaction is conducted hand to hand (immediate exchange). If this is not the case, then such a sale is invalid (fasid) and prohibited (haram).

(2) "Utensil": In Arabic, the word "siqayah" is used, meaning a vessel for drinking water, etc. In Islamic law, it is prohibited to eat or drink from utensils made of gold or silver. It is possible that they purchased it for adornment or decoration, or there may have been some other purpose; in short, they cannot purchase it for drinking.

(3) "More than its weight": Because, in addition to the gold in the utensil, the cost of craftsmanship is also included, but in the sale of gold for gold, any increase or decrease is prohibited in Shariah. Therefore, the solution to this issue is that if a gold utensil is to be purchased with gold, then gold equal to the weight of the utensil should be given, and the wage (for craftsmanship) should be paid separately in the form of silver or something else. Alternatively, such a utensil can be transacted with silver, and a silver utensil with gold, so that the wage is also received and the Shariah regulation is also maintained. In the mutual sale of gold and silver, there is no fixed limit for increase or decrease, so the wage can easily be included in the price. Nowadays, currency notes have resolved such issues.
