Hadith 4487

أَخْبَرَنِي مُحَمَّدُ بْنُ إِسْمَاعِيل بْنِ إِبْرَاهِيمَ , قَالَ : حَدَّثَنَا يَزِيدُ , قَالَ : أَنْبَأَنَا هَمَّامٌ , عَنْ قَتَادَةَ , عَنْ الْحَسَنِ , عَنْ سَمُرَةَ , قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا , وَيَأْخُذْ أَحَدُهُمَا مَا رَضِيَ مِنْ صَاحِبِهِ أَوْ هَوِيَ " .
´It was narrated from Al- Hasan from Samurah, who said:` "The Messenger of Allah said;" Two traders have the choice as long as they have not separated, or until they reach a deal that suits both of th4em or that is satisfactory (to both)"

English translation:
"Or each of them"—this means that each one says to the other: 'Now make your choice, you have the option.' Afterwards, there will be no possibility of returning (to the sale). Both should clarify this matter three times; then, even though the session (majlis) is still ongoing, the option to revoke (the sale) will no longer remain. This same concept has been referred to as 'Bay‘ al-Khiyar' (sale with option) in previous narrations. The second meaning of Bay‘ al-Khiyar has already been explained in Hadith number: 4470.
