Hadith 4354

أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ يَزِيدَ الْمُقْرِئُ ، قَالَ ، حَدَّثَنَا سُفْيَانُ ، عَنْ عَمْرٍو ، عَنْ صُهَيْبٍ مَوْلَى ابْنِ عَامِرٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " مَا مِنْ إِنْسَانٍ قَتَلَ عُصْفُورًا فَمَا فَوْقَهَا بِغَيْرِ حَقِّهَا ، إِلَّا سَأَلَهُ اللَّهُ عَزَّ وَجَلَّ عَنْهَا " ، قِيلَ : يَا رَسُولَ اللَّهِ وَمَا حَقُّهَا ؟ ، قَالَ : " يَذْبَحُهَا فَيَأْكُلُهَا ، وَلَا يَقْطَعُ رَأْسَهَا يَرْمِي بِهَا " .
´It was narrated from 'Abdullah bin 'Amr that the Messenger of Allah said:` "There is no person who kills a small bird or anything larger for no just reason, but Allah, the Mighty and Sublime, will ask him about it." It was said: "O Messenger of Allah, what does just reason;' mean?" Her said: "That you slaughter it and eat it, and do not cut off its head and throw it aside."

(1) “An animal even smaller than this,” for example, a locust. It can also mean “a bird or an animal larger than this,” such as a chicken, pigeon, etc. Both of these meanings are found in فَمَا فَوْقَھَا, and both are correct.

(2) Some people hunt merely as a pastime. Eating is not their objective; rather, they are either fond of chasing with dogs or of marksmanship, and they fulfill their desire in the form of hunting. This is, according to the Shari‘ah, a sin. No living creature can be killed without reason. If it is a lawful (halal) animal, then it may only be hunted or slaughtered for the purpose of eating. And if it is an unlawful (haram) animal, then it may only be killed to protect oneself from its harm, or for other economic necessities, such as business—for example, elephant tusks. Merely to fulfill one’s desire, no living creature may be wasted.
