Hadith 4329

أَخْبَرَنَا إِسْحَاق بْنُ مَنْصُورٍ ، قَالَ : حَدَّثَنَا عَبْدُ الرَّحْمَنِ ، قَالَ : حَدَّثَنَا مَالِكٌ ، عَنْ إِسْمَاعِيل بْنِ أَبِي حَكِيمٍ ، عَنْ عَبِيدَةَ بْنِ سُفْيَانَ ، عَنْ أَبِي هُرَيْرَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " كُلُّ ذِي نَابَ مِنَ السِّبَاعِ فَأَكْلُهُ حَرَامٌ " .
´It was narrated from Abu Hurairah that the prophet said:` 'Every predator possessing fangs is forbidden to eat."

(1) Except for the hyena, the same ruling applies to all other predatory animals. The hyena itself has been exempted from this general ruling by the Messenger of Allah (sallallahu alayhi wa sallam). Every predatory animal necessarily possesses canine teeth (kuchli—sharp teeth), and these play a significant role in hunting. There are a total of four of these, two on the upper and two on the lower jaw. After the four central teeth and the canines come the molars.

(2) The possible reason for declaring predatory animals unlawful (haram) may be that consuming the flesh of such animals could instill predatory traits in humans as well. Furthermore, these predators kill animals and also drink their blood, which is itself unlawful (haram). In other words, their primary food is unlawful. And Allah knows best.

1:
To infer from the general meaning of the verse of Surah Al-An'am: ﴿Say, "I do not find within that which was revealed to me [anything] forbidden to one who would eat it unless it be a dead animal or blood spilled out or the flesh of swine—for indeed, it is impure—or it be [that slaughtered in] disobedience, dedicated to other than Allah"﴾ () that every predatory animal with canine teeth and every bird with talons is lawful, is not correct,
because the hadith of this chapter and the verse of Surah Al-Ma'idah: ﴿And what was eaten by a wild animal—except what you [are able to] slaughter [before its death]﴾ () serve as specific qualifiers (mukhaṣṣiṣ) for the aforementioned verse of Surah Al-An'am.
Furthermore, the verse of Surah Al-Ma'idah is Madinan, whereas the verse of Surah Al-An'am is Makkan.

«وأخرجه مسلم 1933/15، من حديث ما لك به و من رواية يحي بن يحي وجاء فى الأصل : ”سِتِّيْنَ“ !»

Understanding (Tafaqquh)
➊ From the general wording of this hadith, it is understood that all predatory animals, such as the dog, cat, fox, wolf, lion, badger, and hyena, etc., are forbidden (haram).
➋ The narration in which it is mentioned that the hyena is game (i.e., permissible to hunt and eat) is, according to this hadith, abrogated.
➌ This hadith holds the status of a principle; therefore, any animal, whether we know it or not, if it possesses the described characteristic, its consumption is forbidden (haram).
➍ Hafiz Ibn Abd al-Barr said: "Every marfu‘ (attributed to the Prophet sallallahu alayhi wa sallam) hadith in which there is a prohibition must be understood as indicating prohibition (tahrim), except if there is evidence (qarinah) specifying that it is to be understood as recommendation (istihbab)." ➎ The evidence will either be mentioned in the Book and Sunnah, or it will be supported by consensus (ijma‘), or it will be established from the understanding of the righteous predecessors (salaf salihin).
➏ There is consensus among Muslims that impure things (such as excrement, etc.) are inherently impure (najis al-‘ayn) and strictly forbidden (haram), and are never permissible under any circumstance.
➐ There is no difference of opinion among the scholars of the Muslims that eating monkey meat and selling it is not permissible. Ibn Abd al-Barr said that, in my view, the elephant is also included in this ruling. [التمهيد /1157]
➑ The Messenger of Allah sallallahu alayhi wa sallam forbade the use of the skins of predatory animals as carpets. [السنن الكبريٰ للبيهقي 21/1 وسنده حسن]
● Therefore, these skins are not purified even by tanning. The statement of some people that the skin of a dog becomes pure by tanning, and thus it is permissible to make a prayer mat or bucket from it, is rejected due to its contradiction with this hadith.
