Hadith 4088

أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ عَبْدِ الْحَكَمِ ، عَنْ شُعَيْبِ بْنِ اللَّيْثِ ، قَالَ : أَنْبَأَنَا اللَّيْثُ ، عَنْ ابْنِ الْهَادِ ، عَنْ قُهَيْدِ بْنِ مُطَرِّفٍ الْغِفَارِيِّ ، عَنْ أَبِي هُرَيْرَةَ : أَنَّ رَجُلًا جَاءَ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : يَا رَسُولَ اللَّهِ ، أَرَأَيْتَ إِنْ عُدِيَ عَلَى مَالِي . قَالَ : " فَانْشُدْ بِاللَّهِ " . قَالَ : فَإِنْ أَبَوْا عَلَيَّ . قَالَ : " فَانْشُدْ بِاللَّهِ " . قَالَ : فَإِنْ أَبَوْا عَلَيَّ . قَالَ : " فَانْشُدْ بِاللَّهِ " . قَالَ : فَإِنْ أَبَوْا عَلَيَّ . قَالَ : " فَقَاتِلْ ، فَإِنْ قُتِلْتَ فَفِي الْجَنَّةِ ، وَإِنْ قَتَلْتَ فَفِي النَّارِ " .
´It was narrated from Abu Hurairah that:` A man came to the Messenger of Allah [SAW] and said: "O Messenger of Allah, what do you think if someone comes to steal my wealth?" He said: "Urge him by Allah." He said: "What if he persists?" He said: "Urge him by Allah." He said: "What if he persists?" He said: "Urge him by Allah." He said: "What if he persists?" He said: "Then fight. If you are killed you will be in Paradise and if you kill him, he will be in the Fire."

“They will be among the people of Hellfire”: This refers to bandits and those who wage war (muharibin) against Allah and His Messenger. Their punishment can even be execution. When such a person is killed in battle, his punishment is thereby fulfilled. In the Hereafter, too, he will be among the people of Hellfire, because he was killed while openly opposing the Shari‘ah without repentance, and while killing innocent Muslims. For this reason, some scholars are of the opinion that his funeral prayer should not be performed, because his being among the people of Hellfire is definitive. And Allah knows best.
