Hadith 3968

أَخْبَرَنَا عَلِيُّ بْنُ حُجْرٍ ، قَالَ : حَدَّثَنَا شَرِيكٌ ، عَنْ طَارِقٍ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، قَالَ : لَا بَأْسَ بِإِجَارَةِ الْأَرْضِ الْبَيْضَاءِ بِالذَّهَبِ وَالْفِضَّةِ .
´It was narrated that Sa'eed bin Al-Musayyab said:` "There is nothing wrong with renting uncultivated land for gold and silver."

Explanation & Benefits

(1) Since muzar‘ah (sharecropping) has a deep connection with mudarabah (profit-sharing partnership), and both are of the same kind, therefore, along with muzar‘ah, mudarabah has also been mentioned.

(2) Imam al-Nasa’i rahimahullah has used the word “qard” (loan) for mudarabah because “qirad” (investment partnership) is found in mudarabah.

(3) The wealth given for mudarabah will remain as a trust (amanah) in the hands of the mudarib (the one conducting the business). If that wealth—Allah forbid—gets stolen or is lost, for example: it gets lost or is burnt in a fire, etc., then the mudarib will not be held responsible. However, proof or a sworn statement (whichever is appropriate) will be taken from him.

(4) If there is a loss in the business, then it will be considered as a loss from the principal amount. The mudarib will not have to give any share. The owner’s wealth is lost and the mudarib’s effort is lost. Allah, Allah, may there be goodness and peace.
