Hadith 3953

أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ ، قَالَ : حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ ، عَنْ عَمْرِو بْنِ دِينَارٍ ، عَنْ ابْنِ عُمَرَ ، وَجَابِرٍ : " نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ بَيْعِ الثَّمَرِ حَتَّى يَبْدُوَ صَلَاحُهُ , وَنَهَى عَنِ الْمُخَابَرَةِ كِرَاءِ الْأَرْضِ بِالثُّلُثِ وَالرُّبُعِ " . رَوَاهُ أَبُو النَّجَاشِيِّ عَطَاءُ بْنُ صُهَيْبٍ , وَاخْتُلِفَ عَلَيْهِ فِيهِ .
It was narrated from Ibn 'Umar and Jabir that the Messenger of Allah forbade selling fruits until it was clear that they were free of blemish, and (he forbade from) Al-Mukhabarah; leasing land in return for one-third or one-quarter (of the yield).

(1) "There is a difference of opinion." The difference is that when Yahya ibn Abi Kathir narrates from Abu al-Najashi, he attributes this narration to the Musnad of Rafi‘ ibn Khadij; but when al-Awza‘i narrates from Abu al-Najashi, he attributes it to the Musnad of Zuhayr ibn Rafi‘, the uncle of Rafi‘, as will be mentioned in the following narration. Both ways are correct, as has been mentioned previously. This hadith is narrated in both forms in the two Sahihs (Sahih al-Bukhari and Sahih Muslim).

(2) The reason for the prohibition of selling unripe fruit has already been mentioned in hadith: 3910; however, those fruits are exempt from this ruling which are consumed in their unripe state.

(3) By "ripening" is not meant that the fruit must be completely ready to eat, but rather that its color changes; that is, those fruits which ripen by turning yellow should become yellow, and those which ripen by turning red should become red, and those whose color does not change should become somewhat soft. And Allah knows best.
