´It was narrated from Shu'aib:` "Az-Zuhri said: 'Ibn Al-Musayyab used to say: 'There is nothing wrong with leasing land in return for gold and silver, and Rafi bin Khadij used to narrate that the Messenger of Allah forbade that.''"

1؎: That is, he has agreed with Shu'ayb, and this agreement is such that between al-Zuhri and Rafi', Salim is not mentioned, whereas Malik and 'Aqil have mentioned Salim.
Hanzalah ibn Qays said that he asked Rafi ibn Khadij about the lease of land. He replied: The Messenger of Allah ﷺ forbade the leasing of land. I asked: (Did he forbid) for gold and silver (i. e. dinars and dirhams)? He replied: If it is against gold and silver, then there is no harm in it.

Benefits and Issues: From all these ahadith, it is established that if a landowner, in sharecropping (muzara‘ah), specifies the produce of separate portions of the same field for himself and for the sharecropper, then this type of sharecropping is impermissible. And this is the corrupt condition due to which sharecropping has been declared prohibited in its presence. If this flaw is not present, and instead the land is given for a fixed amount, i.e., on lease (theka), then there is no harm in it.
