´It was narrated that Hanzalah bin Qais said:` "I asked Rafi' bin Khadij about leasing uncultivated land in return for gold and silver. He said: '(It is) permissible and there is nothing wrong with that. That is the due of the land.'"

It appears that permitting it in exchange for gold and silver is the personal ijtihad (independent reasoning) of Hazrat Rafi‘ bin Khadij radi Allahu anhu, as will become clear from the forthcoming hadith. Otherwise, the manner in which the Messenger of Allah sallallahu alayhi wa sallam prohibited sharecropping (bata’i), according to that manner, it should also not be permissible in exchange for gold and silver. This is because he forbade sharecropping out of sympathy for the poor, as is explicitly mentioned in previous ahadith. Therefore, it should also be prohibited in exchange for gold and silver, since this too is contrary to sympathy for the poor. In fact, for the poor, sharecropping (bata’i) is better than leasing on a fixed rent. (See: Hadith 3921)
