´It was narrated that Hanzalah bin Qais said:` "I asked Rafi' bin Khadij about leasing land. He said: 'The Messenger of Allah forbade leasing land.' I said: 'For gold or silver?' He said: 'No, rather he forbade leasing it in return for what the land produces. As for gold and silver, there is nothing wrong with that.'"

Hanzalah ibn Qays said that he asked Rafi ibn Khadij about the lease of land. He replied: The Messenger of Allah ﷺ forbade the leasing of land. I asked: (Did he forbid) for gold and silver (i. e. dinars and dirhams)? He replied: If it is against gold and silver, then there is no harm in it.

Benefits and Issues: From all these ahadith, it is established that if a landowner, in sharecropping (muzara‘ah), specifies the produce of separate portions of the same field for himself and for the sharecropper, then this type of sharecropping is impermissible. And this is the corrupt condition due to which sharecropping has been declared prohibited in its presence. If this flaw is not present, and instead the land is given for a fixed amount, i.e., on lease (theka), then there is no harm in it.
