Hadith 3686

أَخْبَرَنِي هَارُونُ بْنُ عَبْدِ اللَّهِ ، قَالَ : حَدَّثَنَا عَفَّانُ ، قَالَ : حَدَّثَنَا سُلَيْمَانُ بْنُ كَثِيرٍ ، عَنِ الزُّهْرِيِّ ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ ، عَنِ ابْنِ عَبَّاسٍ ، عَنْ سَعْدِ بْنِ عُبَادَةَ ، أَنَّهُ أَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : إِنَّ أُمِّي مَاتَتْ وَعَلَيْهَا نَذْرٌ أَفَيُجْزِئُ عَنْهَا أَنْ أُعْتِقَ عَنْهَا ، قَالَ : " أَعْتِقْ عَنْ أُمِّكَ " .
It is narrated from Sa'd bin 'Ubadah (may Allah be pleased with him) that he came to the Prophet (peace and blessings of Allah be upon him) and said: "My mother has passed away and she had a vow upon her. If I free (a slave) on her behalf, will it be fulfilled for her?" He (the Prophet) said: "(Yes,) free a slave on behalf of your mother."

Explanation & Benefits

(1) This narration clarifies the ambiguity found in other narrations where a general vow (nadhar) is mentioned; the vow was to free a slave. Some have said that it is possible the vow was something else, but since a vow is equivalent to an oath (qasam), and the expiation (kaffarah) for an oath is to free a slave, therefore, a slave may have been freed in place of fulfilling the vow. However, the first opinion appears to be more correct.

(2) In the previous narrations, only the bequest (wasiyyah) was mentioned. In this narration, the vow (nadhar) is mentioned. It is possible that both matters were present: she was unable to fulfill her vow and was also unable to make her bequest. Sa’d (radi Allahu anhu) fulfilled both matters. Radi Allahu anhu wa ardaah.
